GOOD MORNING-1SHOT

THANK YOU FOR JOINING US ON NBC2 NEWS TODAY!

IT'S SUNDAY JULY 15TH.

I'M KELLY CRESWELL.

LET'S GET RIGHT TO THIS MORNING'S TOP STORIES. Return to index of stories...

FLORIDA CITIZEN LIST-ONCAM

A VICTORY FOR THE RICK SCOTT ADMINISTRATION-

THE FEDERAL GOVERNMENT WILL NOW GIVE THE STATE OF FLORIDA ACCESS TO A DATABASE WHICH KEEPS TRACK OF NON U-S CITIZENS WHO LIVE IN THE U-S.

THE DECISION WILL ALLOW THE STATE TO USE THE DATABASE TO CHALLENGE PEOPLE'S RIGHT TO VOTE IF THEY ARE SUSPECTED OF NOT BEING A U-S CITIZEN.

THE NBC2 INVESTIGATORS FIRST BROKE THE STORY THAT NON-CITIZENS WERE CASTING BALLOTS. Return to index of stories...

FLORIDA CITIZEN LIST-VOTOPS

THE LIST IS CALLED THE "SAVE" DATABASE AND GOVERNOR SCOTT CAN NOW USE THE INFORMATION TO RESTART A SUSPENDED VOTER REGISTRATION PURGE THAT CAME TO A HALT EARLIER THIS YEAR BECAUSE OF FAULTY DATA.

BEFORE THIS DECISION - THE STATE WAS USING DRIVER'S LICENSES TO REVIEW WHO COULD VOTE. Return to index of stories...

FLORIDA CITIZEN LIST-CGTOPS

HERE'S PART OF WHAT THE GOVERNOR SAID IN A STATEMENT-

"ACCESS TO THE SAVE DATABASE WILL ENSURE THAT NON-CITIZENS DO NOT VOTE IN FUTURE FLORIDA ELECTIONS. I'M APPRECIATIVE THAT.

.THE FEDERAL GOVERNMENT IS WORKING WITH US COOPERATIVELY. THIS IS A STEP IN THE RIGHT DIRECTION. Return to index of stories...

FLORIDA CITIZEN LIST-ONCAM

GOVERNOR SCOTT REQUESTED THIS ACCESS BEFORE -

BUT VOTING RIGHTS GROUPS AND THE OBAMA ADMINISTRATION PROTESTED -

SAYING A VOTER PURGE LESS THAN FOUR MONTHS BEFORE THE PRESIDENTIAL ELECTION DOESN'T LEAVE ENOUGH TIME TO CORRECT MISTAKES THAT COULD BE MADE, LIKE IF AN ACTUAL CITIZEN WHO CAN VOTE IS ACCIDENTALLY COUNTED AMONG THOSE WHO CANNOT.

THIS DECISION MAY ALSO AFFECT PLACES BEYOND FLORIDA BECAUSE COLORADO AND OTHER STATES HAVE ASKED FOR SIMILAR ACCESS TO THE FEDERAL DATABASE. Return to index of stories...

6:02 FIRST ALERT FORECAST ON THE 2'S-WX WALL

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.

IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.

Showers and thunderstorms will return to Southwest Florida today, and our rain chances will even be a little higher compared to yesterday. This means we can expect today's storms to cover more ground during the afternoon and evening.

To start the day, we'll enjoy a mostly clear and sunny sky along with temperatures in the 70s and 80s. By the midday hours, our temperatures will peak in the upper 80s and lower 90s before the developing rain cools us off in the afternoon.

Some of today's storms will be capable of producing very heavy rain, excessive lightning, and gusty winds. The storm movement will mostly be from east to west.

We may see a few storms linger through early tonight before the atmosphere settles down and our sky clear.

On Monday, the steering will be more westerly, which will take many of the afternoon storms inland. Earlier in the day, however, we'll see the potential for scattered showers over the urban corridor and close to the beaches.

Hit and miss afternoon storms, fairly typical of a July pattern, will continue through mid week before an area of high pressure settles in and reduces our rain chances for a couple days.

The focus on Thursday and Friday will be the heat. High temperatures could potentially reach the mid to upper 90 then, and heat indices will be over 100 degrees.

The heat will back off a bit this upcoming weekend, and rain chances will be close to normal again by Saturday. Return to index of stories...

CREDIT CARD FEES-PLASMA-TRX

NOW TO A QUESTION WE HAVE ALL BEEN ASKED-

CASH--OR CREDIT?

AS THE RESULT OF A BLOCKBUSTER SETTLEMENT INVOLVING SOME OF THE NATION'S BIGGEST CREDIT CARD COMPANIES.

THE ANSWER TO THAT QUESTION COULD HAVE A WHOLE NEW PRICETAG.

MICHELLE FRANZEN HAS THE DETAILS, IN THIS NBC2, CONSUMER ALERT. Return to index of stories...

CREDIT CARD FEES-PKG

WE'RE USED TO IT AT THE PUMP: ONE PRICE FOR CASH, A HIGHER ONE FOR PLASTIC.

BUT NOW, THAT CREDIT CARD SURCHARGE COULD BE COMING TO STORES, RESTAURANTS, EVEN DOCTOR'S OFFICES.

NAT DOCTORS OFFICE: here we go

THE SO-CALLED SWIPE FEES REQUIRE MERCHANTS TO PAY CREDIT CARD COMPANIES UP TO 3-AND-3-QUARTER PERCENT TO COVER PROCESSING EXPENSES.

BUT FOR YEARS, MERCHANTS HAVE NOT BEEN ALLOWED TO PASS THOSE SURCHARGES ON TO CONSUMERS.

THIS WEEK,VISA, MASTERCARD AND OTHER BANKS AGREED TO A 7 BILLION DOLLAR SETTLEMENT IN A PRICE-FIXING CASE BROUGHT BY RETAILERS.

THE AGREEMENT NOW GIVES BUSINESSES THE RIGHT TO CHARGE MORE FOR USING PLASTIC. TO OFFSET THE SWIPE FEES.

MFRANZEN STANDUP:

Now that merchants have the green light to pass on sur-charges to the customer, the big question is will they?

Experts say, it's risky:

SOT HITHA PRABHAKAR / RETAIL ANALYST / C111

The second they start putting on those fees for the product and charging the customers more, that's what's going to anger customers and that's the last thing they want to do, especially after coming off of this recession.

EVEN IF THEY DO. SHOPPERS WILL STILL HAVE THE CHOICE TO PAY CASH, OR BY DEBIT CARD, WHICH DOES NOT CARRY A SUR-CHARGE.

WOMAN MOS: You think it doesn't matter, but it definitely adds up when you, when you end up paying the bill.

WOMAN MOS: If ppl started charging to use credit cards, ATM would become my best friend.

THE SURCHARGES WON'T AFFECT EVERYONE. TEN STATES. INCLUDING CALIFORNIA, NEW YORK AND TEXAS.HAVE LAWS PROHIBITING MERCHANTS FROM PASSING THEM ALONG.

AND MANY BIG-CHAIN STORES HAVE THE ABILITY TO NEGOTIATE LOWER FEES WITH CREDIT CARD COMPANIES AND MAY NOT PASS ALONG THE SURCHARGE.

BUT FOR SMALL BUSINESS OWNERS LIKE ANNE BONNER WHO DON'T HAVE THE SAME BARGAINING POWER, SWIPE FEES ADD UP.

SOT ANNE BONNER:

I have such appreciation for my customer's business that I feel really apprehensive about approaching them for uh, for picking that up. / The bottomline is just to keep ppl coming in, and keep ppl happy, and be able to keep doing what I'm doing because I love it.

BUSINESS OWNERS. LOOKING AT A DIFFERENT BOTTOM LINE.

6:42 FIRST ALERT FORECAST ON THE 2'S-WX WALL

DROUGHT WORRIES-ONCAM

WE'RE ABOUT TO ENTER WHAT COULD BE A MAKE-OR-BREAK WEEK FOR A LOT OF FAMILIES AND FARMS IN THE AMERICAN HEARTLAND.

THEY'RE SUFFERING THROUGH THE WORST DROUGHT IN A QUARTER-CENTURY.

FARMERS WHO HAVE SEEN THEIR CROPS DECIMATED THIS YEAR ARE HOPING FOR ANY SIGN OF RELIEF.

AND IT'S NOT JUST FARMERS DEALING WITH THE SLOW BURN.

SOON, WE COULD ALL BE PAYING THE PRICE.

HERE'S NBC'S JANET SHAMLIAN. Return to index of stories...

DROUGHT WORRIES-PKG

It is an astounding number: some 60-percent of the nation is now in some form of drought. more than a-thousand-plus counties across 26 states have been declared disaster areas.

One THIRD of the corn crop is in trouble. On this Illinois farm, it may not be worth harvesting.

Ranchers are struggling too. many having to BUY food for their herds because pastures are barren, there's no grass to graze on.

But there will be growth from these conditions. in the price of food.

Economist Bernard Weinstein says corn prices impact 75-percent of what's sold in the market.

THAT DOESN'T MEAN THAT THE PRICE AT THE SUPERMARKET IS GOING TO GO UP TOMORROW, BUT IT IS GOING TO GO UP NEXT WEEK. AND IT'S GOING TO CONTINUE TO RISE FOR A NUMBER OF MONTHS

Milk and cheese prices could rise as much as 6-percent.

Beef may be cheaper short-term because many ranchers are selling

cattle early. but next summer when there's a shortage, expect to pay much more.

Back on the farm, there's little hope for relief.

sot:

the hardest hit drought areas will see showers and thunderstorms this summer, but they will be spotty and clustered so it wont bring the widespread relief that we need.

There is rain, but not where they who need it most.

Southeast Texas has gone from last year's record drought to a deluge. as much as 15-inches this week alone. as one local put it, swinging it from hell to high water.

GUILTY BY A HAIR-ONCAM

USING SCIENCE TO SOLVE CRIMES HAS BECOME A STAPLE OF PRIME-TIME TV:

BUT NOW THE REAL-LIFE FBI CRIME LAB IS FACING CHARGES OF MISHANDLING EVIDENCE.

A JUDGE NOW SAYS A MAN WHO SPENT 22-YEARS BEHIND BARS IS INNOCENT:

AND NOW THE JUSTICE DEPARTMENT IS REVIEWING HUNDREDS-- MAYBE THOUSANDS-- OF CASES.

HERE'S PETE WILLIAMS WITH THAT STORY. Return to index of stories...

GUILTY BY A HAIR-PKG

Police in Washington, DC were looking in 1981 for a man who raped a woman at gunpoint.

. when they saw someone they thought resembled a sketch drawn from the victim's description.

Kirk Odom was arrested and convicted, and spent 22 years in prison.

"They sent me to hell, to be honest with you, really. They sent me straight to hell."

At his trial, an FBI lab technician testified that a hair found on the victim's clothes was so microscopically similar to Odom's that it was virtually indistinguishable -- a very rare phenomenon, the lab tech said.

But on Friday, Kirk Odom's 50th birthday, a judge formally declared him innocent. A recent DNA test showed it could not have been Odom -- and that the hair was not his.

Ronald Machen, now the US attorney in Washington, says he suffered a terrible injustice:

"The jury was left with a misinterpretation of how strong the link was of the evidence linking the defendant to the actual crime scene.":10

The Justice Department says it's now going through thousands of other cases from the days before DNA testing, to see whether government witnesses exaggerated the significance of the FBI's hair analysis.

The FBI insists that the science itself is sound -- that it's possible to say whether hairs from a suspect bear a microscopic resemblance to hairs recovered at crime scenes.

But a government science panel cautioned three years ago that there are no uniform standards on how many hair features must agree for an examiner to declare a virtual match.

The lawyer for Kirk Odom says hair analysis is junk science:

"It's entirely subjective. So the examiner subjectively evaluates the samples and decides whether or not to call it a match.":08

And now Congress is considering national standards to help prevent what happened to Kirk Odom -- found guilty by a hair.

BUT THAT'S WHERE THE SIMILARITIES END.

It's a shark a shark it's a big ass shark!

That's pretty cool.

Whew, God.

What a dirty scum. He's gone.

It was a big shark.

SARAH BRAME HAD NEVER BEFORE CAUGHT A FISH, LET ALONE ENCOUNTERED A SHARK.

I was actually kind of scared cause I seen it jump. I was like 'oh my gosh. it could jump up here and get me.'

AND WHEN YOU COMBINE THE BALLISTIC AMERICANS.

Holy bleep.

WITH THE CHILLIN' AUSTRALIANS.

Bloody sharks.

YOU GET THE CATCH OF THE DAY.

HOLY BLOODY SHARK. LAST YEAR, AUSTRALIA'S 9 NETWORK MORNING SHOW SENT A REPORTER TO FISH FOR A SHARK SUPPOSEDLY SIGHTED IN A LAKE.

I'm gonna give you one chance to catch this shark.

HIS CAST WAS IMPRESSIVE, BUT HIS CATCH MISSED THE MARK.

You got a duck.

I got a bird I got a bird. I'd go to another shot.

Stop down stop down stop down that's enough.

Peking duck anyone?

Awkward.

BUT AT LEAST THE DUCK WAS FINE, UNLIKE THE MACKEREL THAT FAILED TO DUCK THE SHARK.

NOW ONE PLACE WHERE YOU'LL NEVER CATCH A SHARK IS IN THE NEW YORK CITY SUBWAY, RIGHT?

WELL MAYBE YOU COULDN'T CATCH ONE, BUT YOU COULD BUY ONE. THE WEBSITE GOTHAMIST OBTAINED PHOTOS OF A GUY SELLING A LIVE BABY SHARK ABOARD A J TRAIN AT 1 IN THE MORNING. HE WANTED 100 BUCKS FOR THE LITTLE SHARK HE SAID HE CAUGHT AT CONEY ISLAND AFTER IT BIT HIM ON THE BUTT. BUT SERIOUSLY FOLKS, YOUR CHANCES ARE WAY BETTER OF HOOKING A BUD THAN HOOKING JAWS.

AND GRABBING A BREW SURE BEATS BEING SHARK STEW.
