Kenneth roop making a quick first appearance before a judge this morning. Charged with the second degree murder of a door to door salesman.
That judge ordering roop held on no bond. The family of the man roop is accused of shooting to death in the driveway of his cape coral home , visibly shaken leaving the courtroom.

AN UNPRECEDENTED RULING IN A LEE COUNTY COURTROOM TODAY.
A MAN WHO KILLED A FLORIDA PANTHER IN THE GOLDEN GATE ESTATES AREA IN 2009 WAS SENTENCED.
HE WAS THE FIRST TO EVER BE CONVICTED UNDER THE FEDERAL ENDANGERED SPECIES ACT.
N-B-C TWO'S ELIZABETH BILLINGSLEY WAS IN THE COURTROOM.
Fort Myers, Florida - United States Magistrate Judge Sheri Polster Chappell today sentenced Todd Alan Benfield for shooting and killing a Florida Panther in violation of the Endangered Species Act. Magistrate Judge Chappell sentenced Benfield to 60 days home confinement, to be followed by 30 days of intermittent custody with the Federal Bureau of Prisons, 3 years of probation, a fine of $5,000, a community service payment of $5,000 to the National Fish and Wildlife Foundation, 200 hours of community service at the Florida Panther National Wildlife Refuge or the Rookery Bay National Estuarine Research Reserve, a public apology in the Naples Daily News, a hunting ban during the term of probation, and the requirement of a hunter safety course. The court also ordered Benfield to forfeit the compound bow, arrows, ladder tree stand, and accessories he used to shoot the Florida Panther.
Benfield pled guilty on May 18, 2012.
According to court documents, on October 8, 2009, Benfield was bow hunting along Woodland Grade, in the Golden Gate Estates area of Collier County. On that day, he used a tree stand to hunt for deer. From his tree stand, Benfield knowingly shot and killed a Florida Panther with his compound bow and a 3-blade broadhead-tipped arrow. The following day, Benfield and an associate moved the panther into the Woodland Grade area, in an attempt to conceal the animal. On October 10, 2009, Benfield removed his tree stand from the area in an effort to conceal the fact that he had killed the panther. On the same date, a Florida Fish and Wildlife Conservation Commission officer located the dead panther in a section of thick vegetation, in the Woodland Grade area. The officer determined that the dead panther had been dragged approximately 50 yards.
The U.S. Fish and Wildlife Service National Fish and Wildlife Forensics Laboratory conducted a genetics analysis of a tissue sample taken from the carcass and determined that it was a Florida Panther.
The Endangered Species Act makes it a federal Class A misdemeanor to knowingly "take" an endangered species of wildlife. The term "take" means to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct. The Florida panther is the last subspecies of Puma still surviving in the eastern United States. Historically occurring throughout the southeastern United States, the estimated 100 to 160 panthers are found in south Florida, in less than five percent of their historic range.
This case was investigated by the U.S. Fish and Wildlife Service - Office of Law Enforcement, U.S. Fish and Wildlife Service - Division of Refuge Law Enforcement, National Fish and Wildlife Forensic Laboratory, Florida Fish and Wildlife Conservation Commission - Division of Law Enforcement, Collier County Sheriff's Office - Crime Scene Investigation, Florida Department of Law Enforcement

HE ALSO ADMITTED THAT THE NEXT DAY - HE TRIED TO COVER IT UP BY MOVING THE DEAD PANTHER'S BODY.
BUT BENFIELD'S CONFESSION CAME ONLY AFTER FEDERAL AGENTS USED D-N-A EVIDENCE TO PIN HIM TO THE KILLING.
"he did not start off cooperating, definitely. He -- you know, there's a a difference between someone who cooperates on an investigation and someone who maybe at the end comes in reluctantly and then cooperates."
DESPITE THE COOPERATION - THE JUDGE BUMPED UP THE PROPOSED SENTENCE -- TACKING ON 60 DAYS' HOME DETENTION TO THE 15 CONSECUTIVE WEEKENDS HE'LL HAVE TO SPEND IN JAIL.
PLUS - HE WON'T BE ALLOWED TO HUNT OR OWN HUNTING EQUIPMENT FOR THREE YEARS WHILE HE'S ON PROBATION.
AND THAT SHOT - ENDED UP COSTING BENFIELD 10-THOUSAND DOLLARS - MONEY HE'S ORDERED TO PAY TO HELP IMPROVE THE PANTHER POPULATION.

We're in store for a hotter and drier weather pattern as we round out the work week as a strong ridge of high pressure builds westward from the Atlantic.
Our mornings will start off warm and muggy with temperatures in the upper 70s to low 80s. With plenty of sunshine overhead through the afternoon hours, highs will be running a couple of degrees above the norm as most locations will climb into the middle 90s, with our beach and coastal locations nearing the 90° mark. Combine the actual air temperature with the humidity and the "feels like" temperature will feel a lot hotter than what the thermometer is actually reading. In fact, heat index values will soar into the low 100s.
Due to a drier airmass settling across the Florida peninsula, rain prospects will remain slim to none with the mention of only a late afternoon stray shower.
Not much cooling will take place, as temperatures through the evening hours will be slow to fall. Tonight, expect mostly clear conditions with lows in the upper 70s to near 80° along the coast with mid 70s across our inland communities.
Not much change is in the forecast as we head into the weekend as our weather pattern remains quite stagnant. Rain chances will stay lower than normal as sunshine and hot temperatures dominate through early next week.
