POLICE SAY ROBERT PAGANO POINTED HIS GUN AT TWO CENTURY LINK EMPLYEES OUTSIDE HIS HOME ON SOUTHEAST 22ND TERRACE
NBC TWO'S STEVE CAMPION SPOKE EXCLUSIVELY WITH PAGANO'S WIFE ABOUT WHAT HAPPENED.
Return to index of stories...
The interaction came to a head along this quiet cape coral street.
After two century link employees knocked on pagano's front door, Investigators tell us he stormed out of his backyard and pointed his pistol with his finger on the trigger at the workers standing in this driveway.
Tonight, his wife tells only us Pagano would never raise a gun.

Mariss pagano
1310 "Steve: would your husband pull a pistol and point at the two? Never in a million years. It wouldn't happen."
Mariss Pagano fires back tonight -- telling only us her husband Robert Pagano isn't a violent man.
Pagano 1431 "he's warm, compassion, caring, and would do anything for anybody."
While the wife counters the arrest is a big misunderstanding, cape coral police officers claim Pagano admitted to pulling the revolver to quote "scare the workers."
According to his arrest report, the century link workers needed to repair a phone line and knocked on Pagano's door as a common courtesy.
Brian Hamman, Century Link
0955 "this is a scary situation. We're extremely grateful our guys are okay and safe."
Brian hamman explains current safety measures include driving marked vehicles and wearing uniformed clothes.
He tells us -- given yesterday morning's run in they're reinterating the rules.
Cape police officers argue the workers -- did nothing wrong and people like Pagano need to excerise common sense in their community.
Lt. Tony Sizemore, CCPD
0601 "just the mere fact that someone is knocking on your door is not a threat."
Some neighbors contend Pagano sleeps during the day -- and might have felt threatened.
Karen Marzullo, neighbor
4625 "now it seems like everybody is getting that way. they don't want to open the door because they don't know who is going to be on the other side."
And as this wife waits for husband to come home from jail, she doesn't believe rage played a factor.
Pagano 1353 "I've never seen him raise a pistol. He might have been startled."
"raised a pistol straight at them"

LEE COUNTY IS READY TO TAKE THE CITY OF CAPE CORAL TO COURT.
-Frank Mann/Lee County Commissioner-"We set aside money for litigation last week in hopes we don't have to use it."
BOTH SIDE ARE LOCKED IN A BITTER BATTLE OVER THE CONTROVERSIAL CEITUS BOAT LIFT. THE COUNTY WANTS IT PUT BACK IN. THE CITY OF CAPE CORAL DOESN'T.
N-B-C TWO'S ALEX BOYER JOINS US LIVE FROM THE NEWSROOM WITH TODAY'S DEVELOPMENTS.
Return to index of stories...
THIS BATTLE HAS BEEN BREWING FOR MORE THAN TWO YEARS. LEE COUNTY COMMISSIONERS HAVE BEEN PUSHING FOR THE CITY TO REINSTALL THE BOAT LIFT IN THE NORTH SPREADER CANAL SYSTEM, CITING ITS ENVIRONMENTAL BENEFITS. BUT THE CITY OF CAPE CORAL MAINTAINS THE BARRIER WILL BREACH, JUST LIKE IT HAS IN THE PAST.
Return to index of stories...
THIS IS THE SEVEN-MILE STRETCH OF WATERWAY KNOWN AS THE NORTH SPREADER CANAL SYSTEM. CONDITIONS OUTSIDE ARE CALM. BUT INSIDE THE HALLS OF GOVERNMENT A STORM IS BREWING.
-Frank Mann/Lee County Commissioner-"The idea is to find a resolution and to avoid litigation but from all appearances it looks like Lee County is gearing up for a lawsuit."
LAST WEEK, LEE COUNTY COMMISSIONERS VOTED TO "SET ASIDE" SOME $350-THOUSAND DOLLARS FOR LITIGATION. THAT'S MONEY THAT *COULD BE USED SUE THE CITY OF CAPE CORAL. ONE COMMISSIONER CALLS THAT OPTION - A LAST RESORT.
-Mann-"I know we're sending the wrong signals. As one commissioner I want to say to Cape Coral I want to work with you.
-306 page report being dropped on table
THIS 306-PAGE REPORT DETAILS THE HISTORY OF THE CIETUS BOAT LIFT. THAT HISTORY INCLUDES NUMEROUS BREACHES AND FAILED REPAIR ATTEMPTS.
-Kevin Mcgrail/Cape Councilman-"The City of Cape Coral does not want to put anymore money into barriers. We've proven twice they will fail. What makes us think third time is a charm."
INSTEAD, THE CITY IS OPTING FOR "ENVIRONMENTAL ALTERNATIVES."
-Alex Boyer-"Councilman Kevin McGrail says the city is working on a storm management plan which will basically improve water quality in the north spreader canal system."
BUT SUPPORTERS OF THE BOAT LIFT CLAIM THE BARRIER IS THE ONLY WAY TO SEPARATE THE RIVER OF STORM WATER FROM THE MATLACHA PASS AQUATIC PRESERVE.
Return to index of stories...
IN ADDITION TO STARTING A LITIGATION FUND, LEE COUNTY COMMISSIONERS HAVE ALSO SET ASIDE MONEY TO DO THEIR OWN ENVIRONMENTAL TESTING. THE HOPE IS TO COME TO SOME SORT OF RESOLUTION OUTSIDE OF THE COURTROOM. BUT WITH TIME RUNNING OUT. THAT IS LOOKING LESS AND LESS LIKELY. LIVE IN THE NEWSROOM ALEX BOYER NBC2.

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.
IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.
We'll notice some changes in the rain department today as our rain chances take a little bit of a dip, but we'll still be in line for some hit or miss afternoon storms during the peak heating of the day.
The difference between today and yesterday, though, is today's rain will likely cover much less ground; rain coverage will be considerably lower at 30% instead of Monday's 70%.
It also appears the best chance of getting wet will be over northern portions of the viewing area, so if you live in Collier County, your chances of seeing a storm will be lower than in Charlotte County.
Aside from the isolated afternoon storms, today will be mainly sunny and hot. Temperatures will have the potential to warm into the mid 90s, and the heat index will be near 100 degrees.
Rain chances will dwindle even more Wednesday as some drier air briefly takes hold of Southwest Florida, so the main focus will be on the heat as temperatures soar into the mid 90s.
By Thursday and Friday, afternoon showers and storms will make a comeback, and it looks like the afternoon thunderstorm pattern will be in place through the upcoming weekend as well.
In the tropics, Ernesto is struggling with some dry air at the moment, which has prevented the storm from strengthening into a hurricane overnight. Ernesto still has very warm water to work with as well as an overall favorable environment for future strengthening before landfall tonight near Belize and the Yucatan peninsula. Once Ernesto crosses the Yucatan, the system is expected to briefly move into the southern Gulf, and its final destination will likely be the coast of Mexico Friday morning.
Elsewhere, the former Tropical Storm Florence is no longer a tropical threat as what was left of the system eroded due to dry air and wind shear.
