NEW RIGHT NOW, A TRAFFIC ALERT THAT INTERRUPTED THE MORNING COMMUTE IS IN THE WAY OF DRIVERS HEADING HOME.

THE WESTBOUND LANES OF PALM BEACH BOULEVARD AROUND THE I-75 OVERPASS ARE SHUT DOWN AND TWO EASTBOUND LANES ARE STILL CLOSED BECAUSE OF A CRASH INVOLVING A DUMP TRUCK.

THE CRASH HAPPENED JUST AFTER SIX O'CLOCK THIS MORNING.

FHP SAYS THE BACK OF THE TRUCK WAS UP AND HIT A TRAFFIC LIGHT, SIGN, AND THE OVERPASS, BEFORE FLIPPING OVER AND SPILLING DIESEL FUEL.

NBC2'S KELLY CRESWELL IS LIVE NEAR THE OVERPASS WHERE CREWS ARE CLEANING UP THE FUEL. KELLY? Return to index of stories...

are shut down and two eastbound lanes are still closed because of a

crash involving a dump truck. Return to index of stories...

DUMP TRUCK PALM BEACH BLVD-PKG

For reasons FHP can't explain, the driver of this dump truck had the

bed of the truck up while driving through this intersection, leaving

quite a mess behind hitting a traffic light--this sign-- and then the

overpass--before flipping to its final resting spot. DOT inspected the

overpass and determined it is structurally safe, but the sign had to

be taken down. Even though the truck was towed, there was still a mess

left behind. Diesel fuel spilled over five lanes--causing unsafe

driving conditions.

Take sound

Dave Parks, PIO for construction project "almost like northern

conditions. So we've got to come in and actually tear up the old

asphalt and put new, fresh asphalt down just for safety concern.

Really it makes it a much smoother and safer driving consistency." Return to index of stories...

The construction project spokesperson says this crash shouldn't affect

the project. But what is affected are those of you who have to drive

through this area, and FHP is advising drivers to find an alternate

route. It should be safe to drive on sometime later tonight. Live in

With more canals than Venice Italy -- southwest Florida's largest city battles to safeguard the liquid which makes it so appealing.

The water quality was last reported as "fair" -- just below the state's range for good.

City natural resource workers tell us -- they're always looking for better measures to keep the cape's waterways as clean as possible.

They explain they're confident 2010's ordinance which bans phosphorus and nitrogen fertilizer from june first to the end of this month will work.

For a cape coral newcomer -- she believes educating people about the complex system is key to success.

Joy Barber, Colorado transplant

FORECAST OPEN Return to index of stories...

FORECAST-WXWALL

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.

IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.

RAIN CHANCES INCREASE THROUGH MIDWEEK

You can call Monday our transition day. It started off nice and clear, but after lunch time the clouds started to build and in came the rain.

Monday's rain was very scattered in nature. Tuesday and Wednesday; however, we will see the storms become more numerous.

There's two weather features that will impact our forecast. First is an interesting system off the coast of Louisiana. It's providing the north Gulf Coast states with high rainfall totals. Flood Watches are in effect for much of the southeast. All that rain will continue to spread across the Deep South. Including Florida. Next, a cold front is dropping from the north. It'll arrive by midday tomorrow and essentially stall in north Florida.

The front will help push the Louisana low pressure system to the east - brushing Florida. This will cause our winds to be from the southwest for the next 48 hours, and that spells an uptick in the rain department.

Coastal communities will see showers wash ashore early on both Tuesday and Wednesday. The beach rain quickly migrates inland after the noon hour. As the first line moves through, more will build in the Gulf and move over. It'll be a constant cycle with periods of rain and dry weather.

There will be a lot of clouds, too, and consequently we will se highs stay at 90 or below.

Temperatures don't hit 90 again until Friday when high pressure returns from the Atlantic. Our weather conditions will improve as early as Thursday, and we will see isolated thunderstorms each afternoon within the urban corridor.

There's nothing to worry about out in the tropics! Return to index of stories...

LIFE FOR KIM AND HER HUSBAND JOHN, CHANGED IN AN INSTANT.

FOR UNKNOWN REASONS KIM SUFFERED A BRAIN HEMORRHAGE.

WHEN SHE AWOKE FROM SURGERY SHE WAS IN A MINIMALLY CONSCIOUS STATE.

"She could squeeze your finger, but wasn't communicative. She would say typically one word or up to three word answers for things and would tend not to speak at all unless spoken to."

THERE IS NO STANDARD TREATMENT FOR SEVERE BRAIN INJURIES. BUT, DOCTOR JOSEPH GIACINO HOPES HIS RESEARCH HELPS CHANGE THAT.

"This is the first trial to demonstrate that we can indeed influence the course of recovery from severe traumatic brain injury."

IT FOCUSES ON AMANTADINE. A COMMON DRUG FOR PARKINSON'S THAT WAS ORIGINALLY USED TO TREAT RESPIRATORY INFECTIONS CAUSED BY THE FLU. IN THE TRIAL, BRAIN INJURY PATIENTS WERE EITHER GIVEN AMANTADINE OR A PLACEBO FOR FOUR WEEKS. AT FOUR WEEKS THE FLU DRUG GROUP IMPROVED BY ONE POINTS OVER THE PLACEBO GROUP ON THE DISABILITY SCALE.

"Restoring you know, human interaction between family to family, between a patient and a health care team, I think that's a very significant step forward."

"All I could think about was, what if this was happening to our family."

IT WAS THE GIBSON FAMILY REUNION. AND THE FIRST TIME THE FAMILY HAD EVER GATHERED AT "HAGG LAKE" NEAR GASTON.

IT IS A DAY - THEY WILL *NEVER FORGET.

"I said to my wife, somebody's having a problem, and so I took off and as I was running down, I saw Erik running to the water."

ALL AT ABOUT THE SAME TIME THEY NOTICED THINGS HAD SUDDENLY BECOME QUIET AND SOME CHILDREN PLAYING IN THE WATER - HAD GONE UNDER.AT A STEEP DROPOFF POINT.

"I started yelling, they're drowning, they're drowning, and so."

MICHELLE RUSHING AND THE OTHERS BOLTED FOR THE WATER. UNABLE TO SEE IN THE MURKY WATER. THEY FELT THEIR WAY AROUND UNDER THE SURFACE.

"I had tripped over a couple of them so I was trying to get down and I brought one up."

"You couldn't see any of the other kids in the water, so I was just kind of reaching down trying to grab whatever you could."

"I went out and we just sort of formed a chain."

ONE BY ONE. THE FAMILY BROUGHT EIGHT KIDS. AGES SIX TO 13. TO SHORE.

"So we just tried to work as fast as we could to get them out of the water."

AT FIRST - TWO KIDS WERE NOT BREATHING.

"And she was limp and I didn't think that there was, she was going to wake up and that's why it was amazing to me that just a couple of rolls and her eyes fluttered."

BOTH CHILDREN BEGAN BREATHING AGAIN BEFORE CREWS ARRIVED.

YOU MIGHT THINK SOMETHING LIKE THIS WOULD DRAW A LARGE CROWD. IT DIDN'T. AND THAT BOTHERED THEM - THAT NO ONE ELSE CAME TO HELP.

"I ran by a picnic table full of people, I ran by other people sitting on the beach on towels and nobody was responding."

BUT YESTERDAY. THIS FAMILY DID. AND BECAUSE THEY DID - RESCUE CREWS SAY THEY SAVED THE LIVES OF EIGHT KIDS.

WITH SMALL AND PRE TERM BABIES, ONE OF THEIR MANY CHALLENGES IS BREATHING. MOST HAVE STIFF AND UNDEVELOPED LUNGS. THE CHILDREN'S HOSPITAL RECENTLY UNVEILED A NEW, HIGH TECH DEVICE TO HELP THEM.

DR. KULTAR SINGH/NEONATOLOGIST

RUNS:

:33 This is a new development in our capability to ventilate babies. It improves the synchronicity of the machine with the babies, so it's much easier for babies to breathe.

NAVA- WHICH STANDS FOR NEURALLY ADJUSTED VENTILATORY ASSIST- ATTACHES TO A CONVENTIONAL VENTILATOR. INSTEAD OF FORCING AIR THROUGH THE TUBE AND INTO THE LUNGS, THIS DEVICE SENSES WHEN THE BABY'S DIAPHRAGM IS CONTRACTING.

DR. KULTAR SINGH/NEONATOLOGIST

RUNS:

2:28 It's always machine which is syncing to the baby. It will let baby breathe on his or her pace and it will just assist as needed.:33 They are doing most of the work and the machine is supporting them.

AMY OSHIER/REPORTING

RUNS:

Conventional methods can create a struggle between the patient and the ventilator. Babies who fight the machine may need deeper sedation. But synching to their natural breathing pattern minimizes discomfort and lowers the risk of infection.

DR. KULTAR SINGH/NEONATOLOGIST

RUNS:

4:06 Our sense is they are much more comfortable in it. And we think their number of days on a ventilator are shorter.

A BREAKTHROUGH TECHNOLOGY, NAVA IS HELPING THE TINIEST PATIENTS BREATHE EASY. FOR LEE MEMORIAL HEALTH SYSTEM, I'M AMY OSHIER. Return to index of stories...

A colorful, exuberant trip it has been for William and Kate in Asia--

Today, continuing their stay in the Solomon Islands-- embraced by the people.

Today-- lawyers for the couple will appear in a French court. Seeking criminal charges. Arguing their privacy was breached, their image damaged by the circulation of these photos, of Kate sunbathing topless.

So far, accessible in France, Italy, Ireland and certain US websites.

No publisher in the UK has touched them. A British company that has a joint venture with the Irish newspaper that ran them is now considering cutting ties.

But the publications that have run the photos have staunchly defended themselves--

"Those pictures are not shocking, just a beautiful couple and in love couple."

Today, an Italian magazine-- splashed out with 26 pages, 50 more photos, of Kate sunbathing.

They reportedly have 200 pictures. The editor, tweeting that even a call from the Queen herself would not stop them.

"So why go to court over this? If William and Kate are successful they could see fines levied, people held accountable, future publication of these images stopped and current ones pulled. However, the publications have arguments too. William and Kate were not in the privacy of their home. They were outdoors in view of a road, and they could say whose image was really harmed by these? You might say in fact it was just the the opposite. But once again that question comes up of why didn't their security see this coming? Back to you." Return to index of stories...

A GREEN BERET ACCUSED OF MURDERING HIS TWO YOUNG DAUGHTERS AND PREGNANT WIFE GETS A SECOND CHANCE TO PROVE HIS INNOCENCE.

FOR THE PAST 42 YEARS, JEFFREY MACDONALD HAS INSISTED HE DIDN'T DO IT.

NOW HIS SUPPORTERS HOPE A NEW HEARING CAN CLEAR HIS NAME.

MACDONALD TRIAL-PKG

Throughout the 1970s America was gripped by the case of Jeffrey MacDonald. Handsome, a doctor, a member of the elite Green Berets - accused of stabbing and bludgeoning to death his pregnant wife Collette and their two young daughters, ages two and five

It was horrifically similar to the Manson murders. The word PIG scrawled in blood in the family's apartment at Ft. Bragg, North Carolina. MacDonald claimed hippies chanting "ACID IS GROOVY, KILL THE PIGS" broke into the home, murdered his family and left him injured but alive.

The Army found there wasn't enough evidence to pursue the case, but in 1979 a Federal jury found MacDonald guilty.

SOT: DAVID BRINKLEY

"HE ARGUED THAT A GANG OF CRAZIES BROKE INTO HIS APARTMENT AND DID THE KILLING BUT THE JURY FOUND HE DID IT."

MacDonald maintained his innocence, refusing to even seek parole.

SOT MACDONALD:

"I'M NOT GOING TO TELL TWO OR THREE BUREAUCRATS THAT I'M SORRY FOR SOMETHING I DIDN'T DO, I DID NOT MURDER MY FAMILY."

The case led to a best selling book, "fatal vision", then an NBC miniseries by the same name.

NATSOT MOVIE MUSIC

.which depicted Macdonald as the killer.

SOT MACDONALD

"I'M INNOCENT OF THE CHARGES AND HAVE ALWAYS BEEN INNOCENT."

The case went all the way to the Supreme Court which upheld MacDonald's conviction.

But today, in yet another court, a judge will begin to determine whether new DNA evidence and a defense claim that a Federal prosecutor intimidated a witness to lie are enough to reopen the case.

Jim Blackburn, who prosecuted MacDonald, has since been found guilty of unrelated ethical violations and disbarred. But he says he still believes the verdict was correct.

Collette MacDonald's brother, Bob Stevenson says, "there is nothing new out there."

BUT Jeffrey MacDonald Hopes that's NOT the case, as he continues to fight as he has for 42 years.

SOT MacDonald from old interview:

"THEY CAN'T TAKE AWAY THE REST OF MY LIFE AND BRAND ME AS A MURDERER, I'M NOT, AND I'M NOT GOING TO LET IT HAPPEN." Return to index of stories...
