WE'VE LEARNED POLICE HAVE INCREASED THEIR PRESENCE THROUGH THIS NEIGHBORHOOD TONIGHT.

AND WE TALKED TO THE VICTIM WHO SAYS SHE THOUGHT IF SHE HEADED TOWARD PALM BEACH BOULEVARD, SHE WOULD BE SAFE BECAUSE PEOPLE WOULD SEE WHAT WAS GOING ON.

BUT THAT WAS NOT THE CASE, AND SHE SAYS SHE HAD TO FIGHT OFF HER ATTACKER HERSELF. Return to index of stories...

A restaurant on the corner, and several cars passing by--a 13 year old fort Myers girl thought this corner of palm beach boulevard would be a good spot to get away from a stranger who was following her.

Take sound

Victim

"I kept going straight and I was like I'm going to go where everybody is at so I'll be safe where everybody is looking."

And someone did notice. A cape coral man on his way to a class saw something wasn't right.

Take sound

Jason Byer

"his bike was right in front of her pedal and he was holding her handle bar like kids do. So I didn't know if it was anything or not so I thought to stop but I was late and I kept going."

But he also figured someone else would help. But the 13 year old says that didn't happen, and the situation got scary.

Take sound

Victim

"he was holding me real tight, hurting my hands."

Then she heard something she will never forget.

Take sound

Victim

"he said he killed someone last night and the next one was me."

Fearing for her life, she knew she was the one who could save her life.

Take sound

Victim

When he kind of let loose of my hand a little bit and I saw his scar. And I didn't know what to do. I just punched him as hard as I could."

The man let go and the 13 year old managed to cross the street and call her mom. As she reported the encounter to police, the cape coral man was driving back from his class and saw that the situation was much more serious, and described what he saw to officers.

And Looking back--he wished he would have stepped in to help instead of assuming someone else would.

Take sound

Jason Byer, witness

" Yea I figured everybody should've stopped I guess after I left the girl was yelling for help and everything else and everybody just kept driving. I was really kind if disguised that I kept driving. Fortunately nothing happened to her if something would've happened I would have felt terrible about it." Return to index of stories...

BUT FORMER MEDSTAR PARAMEDIC JASON AUSMAN SAID PUBLICLY PROBLEMS WITH AEROMED AREN'T NEW.

Jason Ausman 49:55 Friday's call was the first one that has become public but this has happened before. :58

Jason Ausman 49:38 it is a well-known fact within our dispatch center that Aeromed is frequently out of county, frequently unavailable for calls. :48

WAHLIG SAYS IT'S NOT THE FIRST- OR LAST TIME- IT WILL BE NEEDED.

Take nats

4628 "operator: 911. What is your emergency? This is the third time. Called you tonight. You come out. You're like you're drunk. It's okay."

Barely able to form a complete sentence -- investigators argue 56 year karen Hallet wouldn't stop calling 911.

4900 "nobody will do anything about it. I've called you 3 times. Nobody will do it."

On their third time out to her cape coral home -- police officers made sure she'd only get one more call. this time From *inside the jail.

Lt. Tony Sizemore, CCpD spokesperson

3927 "it's simple math."

Lt tony Sizemore explains -- when someone calls 911 for a non-emergency -- the next caller is left to suffer.

4128 "if there are multiple lines and our dispatchers have to put someone on hold. those valuable seconds could be life or death."

In hallet's last call to cape dispatch -- she ranted for 7 minutes and 18 seconds about what she called her noisy neighbors.

Delilah, neighbor

2920 "Steve: are you happy she is in jail? It's a lot quieter around here."

Investigators explain every time a person calls 911 -- they treat it with an extreme sense of urgency.

Hallets landlord says -- it's just common sense.

Carl Dileo, landlord

3415 "when you call 911, you call for emergencies. You call once. You don't call 2, 3 times."

Cape cops agree -- saying the system only succeeds if everyone embraces that philosophy.

Sizemore 4143 "if you're on the fence if this is an emergency or not, we say call us."

So when the time comes -- officers arrive to help you. not handcuff you.

5156 "the officers are responding are responding right now. I have to keep you on 911 until theyre with you. You dialed for help. I dialed for help 3 times and nobody did anything." Return to index of stories...

TOM IS ONE OF HUNDREDS OF CAPE CORAL RESIDENTS OPPOSED TO A 7-11 BEING BUILT ON A RELATIVELY SMALL COMMERCIAL LOT ON THE NORTHWEST CORNER OF CAPE CORAL PARKWAY AND SKYLINE BOULEVARD.

-Kotowski-"How does one developer have the influence to get this decision made on his behalf."

EARLIER THIS MONTH THE PLANNING AND ZONING COMMISSION VOTED TO *APPROVE THE PROJECT AFTER HEARING AN IMPASSIONED SPEECH FROM THE DEVELOPER.

-Dan Creighton/Developer-"If a 711 doesn't belong here it belongs nowhere in our city."

THAT DECISION PROMPTED THE FRUSTRATED GROUP TO APPEAL THE DECISION TO CITY COUNCIL.

-John Cariosca/Cape Councilman-"As far as I know it's the first time citizens have actually taken up the appeal."

IN THE APPEAL LETTER OBTAINED EXCLUSIVELY BY NBC2, OPPONENTS SAY "WE BELIEVE THIS EXCEPTION, IF ALLOWED, WOULD CHANGE THE CHARACTER OF OUR NEIGHBORHOOD."

MAYOR JOHN SULLIVAN AGREES.

-Mayor John Sullivan-"I'm not going to support the gas station going in there."

AND NEITHER WILL COUNCILMAN JOHN CARIOSCA.

-Cariosca-"This area, this block is too small for a gas station let alone a 711 and a gas station."

ALONG WITH THE 5-PAGE PETITION, RESIDENTS INCLUDED A MAP -- DRIVING HOME THE POINT -- THAT THE MAIN WAY IN AND OUT OF THEIR NEIGHBORHOOD -- IS PAST THE PROPOSED 7-11.

-Kotowski-"This intersection is the defining -- if you will -- gateway feature to get into our community."

FIRST ALERT FORECAST-WXWALL

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.

IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.

CLOUDS CONTINUE - SHOWERS ON THE WAY

A lot of moisture continues to ride over south Florida and we can expect skies to stay mostly cloudy tonight. The temperatures will drop to the lower 70's tonight as only a few showers pop up on radar after sunset. There is a frontal boundary still draped across the area and this front will gradually move toward us tomorrow. This would argue for more showers on Wednesday, and possibly a thunderstorm in the afternoon. Although it's not clear-cut in the computer models for tomorrow, I would not be surprised to see a few showers before noon as well. Our warm and humid weather will continue tomorrow with a high in the upper 80's - just shy of 90 degrees.

Looking ahead to the rest of the week it appears that we have several more days of variably cloudy skies and scattered rain showers or storms. With a bit more sunshine in play we should top out around 90 on Thursday, Friday and through the weekend. The long-range forecast shows another front moving in on Monday next week. Right now it looks like this would mean more showers next week but not cooler weather or a drop in humidity. Return to index of stories...
