Families members from both sides of a medical malpractice hearing-- caught in a tense moment.
Daughter: "I'm not moving"
Doctor zannos grekos' wife asks the bailiff to kick the family of grekos' deceased patient out of the courtroom for being disruptive.
The patients daughter, in tears, fired back with a curse.
She was asked to stay quiet.
"15:20:18 I'm crying, I'm sorry I'll bite my lip until I stop crying."
Doctor Grekos is in court fighting for his right to practice medicine. The state suspended his medical license after two of his patients died following a controversial stem cell procedure performed at his bonita springs office.
This case focuses on the first patient-- Domenica fitzgerald-- a breast cancer survivor who hoped the treatment would heal nerve problems caused by chemotherapy.
Dr. Patrick mathias, cardiologist
"15:31:32 this procedure should never have been done and placed the patient at considerable risk 40"
A cardiologist testifying for the state says it was inevitable that the procedure would lead to a stroke.
Dr. Patrick mathias, cardiologist
16:04"There's no way an individual can consent to a procedure like this if they were told that they are highly likely or definitely going to have a stroke 13
The defense says grekos is not at fault and did everything he could to help fitzgerald.
Grekos' patients took the stand to defend their doctor--saying they knew the risks of the procedure, and owe their lives to grekos.
Grekos' mother and fitzgeralds close friend , says she helped care for her after the procedure-- and says fitzgerald was healthy when she got home. She claims a fall is what injured the recovering patient.
Grekos' patients also took the stand to defend their doctor--saying they knew the risks of the procedure, and owe their lives to grekos.

TRIAL IS EXPECTED TO WRAP UP TOMORROW-- BUT WE WON'T GET A DECISION FROM JUDGE FOR AT LEAST 30 DAYS.

FUEL DELIVERIES TO THE CITY OF CAPE CORAL ARE BACK ON TRACK.
TWO WEEKS AGO, THE CITY'S FINANCE DIRECTOR MADE AN EMERGENCY REQUEST TO COUNCIL TO SWITCH FUEL VENDORS - AFTER LEARNING THE CITY'S MAIN FUEL SUPPLIER - WAS IN BANKRUPTCY.
NBC2'S ALEX BOYER REPORTS FROM CAPE CORAL.

Vicky bateman tells me her primary concern was to keep the city's 800 vehicles - many of them police and fire trucks - moving.
So she asked council to give her the go ahead to switch fuel vendors.
Council said yes. But just one week later, bateman decided to give evans another chance.
-victoria bateman/city finance director-"evans ended up being purchased through receivership after going bankrupt so once evans was up it took about a week or so to get back in business delivering. But as soon as they were we picked them back up."
Bateman tells me so far so good. Fuel deliveries are made twice per week, and are being made on time.

TONIGHT; THE NBC2 INVESTIGATORS REVEAL THE FLORIDA PERVERSION FILES.
AD LIB WEATHER TEASE
Return to index of stories...
THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.
IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.
VERY FEW SHOWERS
Weather conditions for the next few days will continue to be pretty quiet here in southwest Florida. I expect a few, mainly inland, showers this evening and the steering winds off the Gulf of Mexico will keep pushing the very limited rain showers to the other side of the state. Generally, a partly cloudy sky and temperatures slowly falling into the 70's will be the forecast tonight.
Tomorrow's weather looks similar to today. We will see lots of sunshine in the morning and partly cloudy weather by the afternoon. Temperatures on Friday will start in the lower 70's and end up in the mid 80's by late day. Rain chances will still be less than 20% tomorrow. Only a few showers are possible as a weak front moves across central Florida and gets weaker over us.
Get ready for a really nice, fall weekend in southwest Florida. Lots of sunshine is on the way and it looks like we will have our first "cool" morning on Sunday! With clear skies and a light northerly breeze, the computer forecasts are predicting a low on Sunday morning around 65 degrees! That temperature won't be anywhere near a record, but it should be the first morning this season with a really different "feel" outside!
