*take pkg*

*take sot* COVER chuck 12:14 "my heart has been ripped out of my chest- my daughter, jesse, my wife and myself- before, we were one."

no one can argue that the death of 11 year-old jesse watlington was tragic.

50:04 "we all expect that our children will out live us."

but now comes the multi-million dollar question of who is responsible.

the watlington family says mcgregor baptist church and southwest florida christian academy are.

11:42 "this could have been prevented."

today-

jesse's parents stood behind their attorney to announce they've filed a lawsuit- seeking millions from the church and school where their 11 year-old was struck by lightning.

53:24 "no body can control a tragedy, but when they do happen, we can be prepared. we can anticipate."

early october,

the child was running out onto the football field for practice- when a lightning bolt struck him directly in the heart.

jesse died days later at a tampa hospital.

10:15 "i want to make sure that he's the last child in florida that's needlessly endangered- struck by lightning."

the watlingtons claim the skies were dark- and the kids were unsupervised when heading out to the field.

the church has denied those claims-

stating that coaches were there, and it was a clear day.

there's also the dispute of a lightning detection device.

the pastor previously told us the church has one and it was working, but wouldn't go into any other details.

the watlingtons say it was stored in a closet.

11:13 "every single kid on that field has told us it was not on the field. we've had people come forward."

jesse's family also says if the school had a defibrillator- the 11 year-old might have been saved,

they go on to say coaches waited 10 minutes to perform cpr because they didn't know how.

however a police report states that one coach ran to call 911, while 2 others began performing cpr.

*take sot* chuck "everything i see and do, i think of my son. not one second goes by. i can't see anything without thinking of him and how needless this tragedy was." Return to index of stories...

N-B-C TWO'S ELIZABETH BILLINGSLEY REPORTS ON THE LATEST DRAMA IN THE ROBERT DUNN MURDER TRIAL. Return to index of stories...

DUNN TRIAL DELAY-PKG

HIS ATTORNEYS SAY THEY DIDN'T SEE IT COMING -

"Fundamentally judge, it is motivated by mental illness. It is infused with judgment that is infected by a biochemical imbalance."

QUIETLY -

ROBERT DUNN WENT AGAINST HIS ATTORNEYS' ADVICE.

"I want to testify."

DUNN IS ACCUSED OF KILLING HIS ESTRANGED WIFE, CHRISTINE DUNN, INSIDE THIS DAYCARE CENTER NEARLY FIVE YEARS AGO.

BUT THE JUDGE REMINDED DUNN HE'D CONFESSED TO CAPE CORAL POLICE THAT DAY -- MAKING INCRIMINATING STATEMENTS -- AND THE JURY WOULD BE ABLE TO HEAR ALL OF IT IF HE TESTIFIED.

"highly critical of the decedent, do you remember that? I don't.

DUNN TALKED IT OVER WITH HIS ATTORNEYS AGAIN - AND CHANGED HIS MIND.

"having conferred with counsel? I want to plead guilty to all charges. I don't want to testify."

THAT WAS NEWS TO HIS LAWYERS TOO -

WITH NO DEAL IN THE WORKS, HIS ATTORNEYS ASKED TO HAVE PROFESSIONALS EVALUATE DUNN.

BUT THE PROSECUTORS CRIED FOUL -

"We have no way of knowing whether or not this is in fact simply a tactic to avoid the trial by the defendant himself and avoid that verdict."

BUT THE JUDGE WANTS TO AVOID AN APPEAL ON THE ISSUE - AND AGREED TO PUT THE TRIAL ON HOLD FOR ONE WEEK WHILE MENTAL HEALTH EXPERTS EVALUATE DUNN.

THE ATTORNEYS WILL ARGUE HIS COMPETENCY NEXT MONDAY MORNING.

FIRST ALERT FORECAST-WXWALL

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.

IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.

GREAT WEATHER CONTINUES

It was an interesting day across Florida. Our part of the state was sunny and nice while clouds and cool temperatures prevailed to the north …. Orlando was only in the 60's and cloudy all day today! An area of low pressure in the Atlantic has kept a northerly wind flow over the state and, thankfully, the clouds and chilly temperatures did not make it here. Tonight, as the temperatures cool back into the 60's, we may pick up a few clouds drifting down from the north. Partly cloudy weather will start off Tuesday with a low in the mid 50's. Temperatures will recover to the upper 70's tomorrow and skies will be partly cloudy throughout the day. As we look ahead to the Thanksgiving holiday the weather pattern in our part of Florida still looks good. A few clouds are in the picture for Wednesday and mostly sunny weather comes back for Thursday and Friday. Daytime highs will be in the mid and upper 70's with over night lows in the mid 50's this week. It doesn't appear that we will be dealing with any significant weather this week and into the upcoming weekend. Return to index of stories...

DOUBLE WIDES ON THE WATER-2SH-SOT-OC

A BOAT CANOPY CONTROVERSY IN CAPE CORAL -

SOME PEOPLE ON THE WATER SAY THEIR VIEW IS CHANGING FOR THE WORSE.

-Jill Turner-"A narrower waterway its just going to be boat dock after boat dock, canopy after canopy."

BUT AS NBC2'S ALEX BOYER FOUND, CITY LEADERS MAY BE LOOKING TO RELAX THE REGULATIONS. Return to index of stories...

DOUBLE WIDES ON THE WATER-PKG

IT'S THE WATERFRONT VIEW THAT DREW THE TURNERS TO THE NORTHWEST CAPE.

-The couple talking looking out over the water

BUT THEIR VIEW TO THE WEST IS PARTIALLY BLOCKED.

-Jill Turner/Homeowner-"The sunset set right over the west, right there but we can't see it, it's gone."

STANDING IN THE WAY OF THEIR PICTURESQUE SUNSET -- THEIR NEIGHBOR'S BOAT CANOPY.

-James Turner/Homeowner-"If you could see the view before this, it was great."

AND NOW THE TURNERS WILL HAVE 2-BOAT CANOPIES TO CONTEND WITH.

-James-"I could see having one but not two on a piece of property."

LAST MONDAY, COUNCIL VOTED TO ALLOW THE TURNERS NEXT-DOOR NEIGHBOR TO ADD A SECOND BOAT CANOPY. CITY ORDINANCE ONLY ALLOWS ONE.

-Jill-"It's just too big for an 80 foot lot.

SINCE 2010, THERE HAVE BEEN 8 REQUESTS FOR AN ADDITIONAL CANOPY. SIX HAVE BEEN GRANTED BY THE CITY.AND TWO OF THEM DENIED.

WITH MORE AND MORE PEOPLE BUILDING ON CAPE CANALS, COUNCILWOMAN RANA ERBRICK EXPECTS EVEN MORE PETITIONS TO FOLLOW.

-Rana Erbrick/Cape Councilwoman-"A boat is an expensive asset people want to protect them."

WHICH IS WHY ERBRICK WANTS THE CITY'S BUILDING OFFICIAL TO TAKE A LOOK AT THE ORDINANCE -- TO SEE IF IT NEEDS TO BE UPDATED.

-Erbrick-"It's one of those ordinances that will need to be revised."

BUT WATERFRONT RESIDENTS LIKE THE TURNER'S DISAGREE -- CLAIMING "DOUBLEWIDES" ON CAPE CANALS ARE A KILLER TO THE COMMUNITY.

-Jill-"A narrower waterway it's just going to be boat dock after boat dock, canopy after canopy. No one will see anything and no one will purchase a house because of that."
