EXTRA RESTRICTIONS TONIGHT FOR WHAT HOMEOWNERS IN CAPE CORAL CAN PUT ON THEIR PROPERTY.
TODAY, THE PLANNING AND ZONING COMMISSION BASICALLY SENT A MESSAGE. THAT JUST BECAUSE YOU OWN THE LAND -- DOESN'T MEAN YOU CAN'T PUT ANYTHING YOU WANT ON IT.
WE ARE TALKING RULES ABOUT SHEDS, GARAGES, EVEN PLAYHOUSES.
NBC2'S ALEX BOYER JOINS US LIVE IN THE STUDIO WITH THE FALLOUT ALEX?

SOME CAPE CORAL HOMEOWNERS WE SPOKE TO ARE FINE WITH THE PROPOSED RESTRICTIONS -- SAYING THE NEW GUIDELINES HELP KEEP THE CITY LOOKING GOOD. BUT OTHERS CLAIM THE CHANGE IS JUST ANOTHER EXAMPLE OF GOVERNMENT OVERSIGHT.

JOHN VANDERHEYDEN TAKES PRIDE IN KEEPING HIS CAPE CORAL HOME LOOKING GOOD.
-John raking leaves/yard
VANDERHEYDEN IS ALL FOR RULES, BUT BELIEVES THE CITY IS INFRINGING ON HIS RESIDENTIAL RIGHTS.
-John Vanderheyden/Homeowner-"It's insanity."
VANDERHEYEN IS REACTING TO A NEW ORDINANCE WHICH LIMITS WHAT CAPE CORAL HOMEOWNERS CAN BUILD ON THEIR PROPERTY.
-Vanderheyden-"This is your property why couldn't you."
UNDER THE AMENDED GUIDELINES, RESIDENTS ARE RESTRICTED TO BUILDING: GARAGES, SATELITTE ANTENNAS, SUN SHELTERS, GAZEBOS, SHEDS, PLAYHOUSES AND RECREATIONAL FACILITIES.
THOSE "RECREATIONAL FACILITIES INCLUDE THINGS LIKE TENNIS COURTS. THE CITY'S PLANNING AND ZONING COMMISSION UNANIMOUSLY APPROVED THE ORDINANCE.
-Patti Martin/P&Z Chair-"I think it was just pulling it all together and clarifying what is allowed because in the past there have been questions involving sheds for instance."
DENISE SCHROEDER DOESN'T MIND THE RESIDENTIAL RESTRICTIONS.
-Denise Schroeder/Homeowner-"Some people can get carried away."
SCHROEDER - WHO MOVED TO THE CAPE 4-YEARS AGO - BELIEVES PEOPLE TAKE ADVANTAGE OF RELAXED REGULATIONS. AND WOULD RATHER HAVE STRICTER RULES IN PLACE.
-Schroeder-"Some people could get out of control with it. So you feel there do need to be guidelines? A little bit."
Return to index of stories...
NOW THIS IS NOT A DONE DEAL. THE ORDINANCE WILL MOVE FORWARD TO CITY COUNCIL FOR REVIEW AND FINAL APPROVAL. AT THAT POINT, COUNCIL CAN DECIDE TO MADE CHANGES, APPROVE THE ORDINANCE AS IT STANDS OR DENY IT. WE'LL KEEP YOU POSTED.

HOPES OF A DEAL TO AVERT THE SO CALLED FISCAL CLIFF ARE FADING.
SO MUCH SO--
THAT THE PENTAGON IS NOW MAKING PLANS FOR MASSIVE CUTS TO ITS BUDGET.
KAREN TRAVERS IS IN WASHINGTON.
Return to index of stories...
TODAY PRESIDENT OBAMA ISSUED A STRONG WARNING TO REPUBLICANS - DO NOT USE
THE DEBT CEILING AS A BARGAINING CHIP IN THE FISCAL CLIFF TALKS.
SOT Obama:
"That is a bad strategy for America, it's a bad strategy for your businesses
, and it is not a game that I will play."
THE OBAMA ADMINISTRATION HAS MADE IT CLEAR THAT RAISING THE DEBT CEILING
SHOULD BE PART OF ANY FISCAL CLIFF DEALAND IT SHOULD BE DONE WITHOUT ANY
CAPITOL HILL DRAMA.
BUT THE PRESIDENT TODAY ACCUSED REPUBLICANS OF PLANNING TO AGREE TO EXTEND
THE MIDDLE CLASS TAX CUTS WHILE LETTING THE TOP RATES INCREASE.JUST TO BE
IN A BETTER BARGAINING POSITION NEXT YEAR ON THE DEBT CEILING.
IT'S UNCLEAR IF NEGOTIATIONS ON THE FISCAL CLIFF ARE EVEN HAPPENING.
DESPITE THE PRESIDENT'S OPTIMISTIC TONE:
SOT Obama
"We can probably solve this in about a week. It's not that tough."
THE TWO SIDES ARE DEADLOCKED WHEN IT COMES TO RAISING TAX RATES.
SOT Obama
"Let's allow higher rates to go up for the top 2 percent."
SOT Boehner
"There are ways to limit deductions, close loopholes and have the same
people pay more of their money to the federal government without raising tax
rates, which we believe will harm our economy."
BUT SOME REPUBLICANS HAVE ALREADY INDICATED THEY WOULD BREAK WITH THEIR
PARTY - AND SUPPORT RAISING TAXES ON THE TOP TWO PERCENT OF EARNERS IN ORDER
TO REACH A DEAL.
SOT Schumer
"The House Republican leadership are like generals hunkered away in a bunker
, who don't realize that their army in the field has already laid down its
arms."

SCRIPT:
She's the innocent baby girl trapped in a bitter custody battle
On one side, the girl's biological father
On the other - her adoptive parents.
Terry Ay-Chan is a staff sergeant in the U.S. army
Two years ago, while he was stationed in South Carolina,
His ex-wife, Tira Bland, was giving birth in Utah.
Ay-Chan says he had no clue - he was never told he was going to be a father
- OR - that his baby girl had been put up for adoption.
SOT - Mark Wiser/ TERRY ACHANE'S ATTORNEY -
"She has a right to be able to be with her father. And that was taken away."
A-Chan's attorney says his ex-wife intentionally gave the adoption agency
the wrong contact information
Meaning they could never reach him for his consent.
SOT: Dan Abrams, ABC News Legal Expert
"They knew, the adoption agency knew, it was doing the adoption without his
consent or permission or knowledge. And warned the adoptive family about
that, saying we might have a problem down the line."
That problem is now playing out in court.
A judge has ordered the girl's adoptive parents, Jared and Kristi Frei, to
give the child back to Ay-Chan within 60 days
But they aren't giving in, their lawyers telling ABC News in a statement:
"THEY BELIEVE THE DISTRICT COURT MADE SOME FUNDAMENTAL ERRORS IN ITS
DECISION AND THEY WILL RAISE THOSE WITH THE APPROPRIATE APPELLATE COURT."
SOT: Dan Abrams, ABC News Legal Expert
"This is a really sad case all around. It's possible that every single
person involved in this case was trying to do what's in the best interest of
the child."

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.
IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.
After some sunshine today, the clouds certainly thickened up throughout the afternoon limiting our temperatures to the upper 70s. Through the evening hours, expect mostly cloudy skies to stick around along with the possibility of a stray shower or two as temperatures settle into the lower 70s.
Overnight, the vast majority of us will stay fairly dry under mostly cloudy skies with an isolated shower at best. Lows will settle into the lower 60s here in town, with a few upper 50s deeper inland and across our northern cool spots.
High pressure that has controlled our weather over the last several days continues to break down as a cold front pushes across the deep south. By tomorrow morning, a weak upper level disturbance will make its way across the peninsula and may produce a few widely scattered showers. Rain prospects will remain about 30%, so not everyone will see the rain as most of these will be the hit or miss type.
Once this disturbance exits to the east late Thursday, conditions will begin to dry out a bit for the end of the week with more sunshine and highs remaining in the lower 80s.
Heading into the weekend, we'll keep partly sunny skies in the forecast with the chance of a couple of isolated showers. By early next week, we'll be tracking another cold front moving down the state, which will bring an increase in the cloud cover and perhaps another boost in our rain chances.
Even though our rain prospects will stay slightly higher than normal, our weather pattern will stay fairly consistent with our temperatures staying a few points above the average with partly sunny skies.
