Naples police department dash cam video shows a woman doing a field sobriety test last May after she drove the wrong way on 5th avenue.
She hit a pedestrian and two cars.
The officer conducting the test is 15 year veteran ryan schickfus.
According to an internal investigation obtained by NBC 2, witnesses on the scene say they saw the woman stumbling out of a bar and into her car before the accident. The investigation also found that based on witness testimony and this video-- officer shickfus had probable cause to arrest the woman for DUI-- but he let her off the hook because they used to work together.
Schickfus in dash cam video:
"58:09 you're not gona go to jail tonight, I know you, you seem to be talking fine, I can smell the alcohol on you 16. 32 you think you're ok to drive home? Yes. You sure?"
Chief tom weschler, naples police department:
"11:24 allowing that to take place in that incident was definitely a public safety risk. 9:00 in my opinion it was a lack of judgment, poor judgment."
Schickfus was suspended in November without pay for 10 days and removed from the night dui detail. He's now working patrols on the day shift.
While working this past monday-- officer schickfus hit a pedestrian with his patrol car while turning onto us 41. A collier county sheriffs office investigation found him at fault. He's now the focus of yet another internal investigation.
Chief: 10:46 we take this very seriously
Back in 2006 officer schifkus was given a three day suspension for unprofessional behavior after he mouthed off to a teenager he pulled over, laughing at him and towing his car-- even though the teenager passed his dui test.
That same year he was investigated for putting pedestrians at risk as he sped down busy fifth avenue to pull someone over.
We asked the Naples police chief why he hasn't fired Schifkus.
9:30 that's one of the frustrations of police cheifs throughout the state of fl when you deal w these things you have to deal w progressive discipline you have to deal w contracts you have to deal w the florida officers bill of rights

A picture perfect weekend is in the works as the sun keeps shining on Southwest Florida and temperatures continue to warm up.
We'll enjoy wall to wall sunshine through our weekend with daytime highs closing in on 80° Saturday and then breaking into the low 80s Sunday.
Overnight and early morning temperatures will still be a little cool with morning lows Sunday dropping into the mid to low 50s once again. Humidity levels will also be quite comfortable both Saturday and Sunday, and winds will be fairly light out of the north and east from 5-10 mph.
With the air being so dry, rain prospects will stay very slim through the weekend and into the first half of next week.
For the boaters and beach goers, conditions on the waters will be very nice; winds will be out of the northwest at 10 knots, and seas will only get up to 2 feet. Inland waters should also be fairly smooth.
As we head into next week, a south wind will bring in more warmth and increasing humidity. Daytime highs will exceed 80° from Monday through Wednesday, and in fact, we'll even hit the mid 80s by Wednesday afternoon!
The next cold front will come sweeping through Southwest Florida early Thursday, and there appears to be enough moisture and energy with this system to bring us some scattered rain followed by another stretch of cooler weather by the end of the week.

:06 This is your original joint where you've worn down the cartilage and worn down the socket.
THE FUNDAMENTALS OF A HIP REPLACEMENT HAVEN'T CHANGED MUCH.
DR. ED HUMBERT/ORTHOPEDIC SURGEON
JOINT DEMO- HIP
:06 Hip replacement is removing the damaged cartilage and bone.
BUT IN RECENT YEARS MORE AND MORE DOCTORS ARE TAKING A DIFFERENT APPROACH.
DR. ED HUMBERT/ORTHOPEDIC SURGEON
RUNS:
1:23 Hip replacement is the one procedure in orthopedics that the approach can vary based on the surgeon you choose. 1:23 You can come through the posterior buttock region or you can come from the direct front of the hip joint or you can come in through the side of the hip joint.
THE MOST COMMON WAY IS TO ACCESS THE JOINT IS THROUGH THE BACKSIDE, WHICH COMES WITH SOME RESISTANCE.
DR. ED HUMBERT/ORTHOPEDIC SURGEON
RUNS:
01:49 The posterior approach does go through the biggest muscle in the body which is the gluteus maximus muscle. So you split that muscle, you have to actually remove some of the short external rotator muscles of the hip joint and hip capsule to get to the hip.
JENNIFER INSKEEP LABORED OVER THE IDEA OF A HIP REPLACEMENT FOR YEARS.
JENNIFER INSKEEP/ANTERIOR HIP PATIENT
RUNS:
2:45 I'm an active person and I was very tired of hurting every time I did something.
THE NEWER, ANTERIOR OR FRONTAL APPROACH HELPED CHANGE HER MIND.
JENNIFER INSKEEP/ANTERIOR HIP PATIENT
RUNS:
10:19 This procedure is easier, shorter healing time because they don't cut the buttocks muscle. That's one less thing that has to heal.
DR. ED HUMBERT/ORTHOPEDIC SURGEON
RUNS:
3:33 You literally don't move any muscles or tendons off the bone. So you're basically separating and pushing the muscles apart as opposed to cutting them and splitting them. That procedure done correctly is a dramatic improvement as far as pain control and recovery times.
AMY OSHIER/REPORTING
RUNS:
A primary concern with hip replacement are dislocations- which are more common if the muscles have been cut. Using the anterior approach, or going through the front of the body, cuts down on that complication.
DR. ED HUMBERT/ORTHOPEDIC SURGEON
RUNS:
8:51: Right, you maintain the soft tissue, you maintain the hip capsule and the short external rotator muscles, which are very protective.
THE CHANGE IN ATTITUDE SAT WELL WITH JENNIFER.

Return to index of stories...

--REPORTER PKG-AS FOLLOWS--
FOR WEEKS, NEIGHBORS KNEW THERE WAS TROUBLE AT THIS FORMERLY EMPTY WATERFRONT HOME.
I got an email from the homeowners association saying there were intruders living in the house.
23 YEAR OLD ANDRE BARBOSA HAD SOMEHOW GOTTEN IN, AND WAS CLAIMING THE HOUSE AS HIS, CITING THE LITTLE KNOWN "ADVERSE POSSESSION" LAW
I did walk around the back of the house and I noticed they had changed all of the locks.
BUT NOW AFTER NEIGHBOR OUTRAGE LED TO INTERNATIONAL NEWS COVERAGE THE OWNER OF THE HOUSE, BANK OF AMERICA, HAS FIRED BACK. FILING A LAWSUIT FRIDAY TO FORCE OUT BARBOSA AND HIS FRIENDS. SOME OF WHOM DROVE OFF THURSDAY WITHOUT ANSWERING QUESTIONS. THEIR LICENSE PLATE TAPED OVER.
BANK OF AMERICA SAYS IN ITS COMPLAINT THAT BARBOSA IS A "SQUATTER" IN WRONGFUL POSSESSION OF THE HOME WITHOUT PERMISSION OR CONSENT.
IT ASKS FOR A PERMANENT INJUNCTION RESTRAINING BARBOSA AND OTHERS FROM TRESPASSING ON THE PROPERTY. BUT SOME ARE QUESTIONING HOW BARBOSA CAME UP WITH THE SCHEME IN THE FIRST PLACE.
I have the theory that this kid is working for somebody else. He's just the warm body that has to occupy the house to make it legal. Because I don't know how he would have found this law that most of us have never heard of.
NEIGHBORS SAY IT WAS ACTUALLY THIS MAN. PAUL MURRAY. WHO FIRST APPEARED AT THE HOME AND SAID HE WAS MOVING IN.
MURRAY HANDED OUT THIS BUSINESS CARD, WHERE HE CLAIMS TO BE A "PHOTOGRAPHER EXTRAORDINAIRE."
HIS FACEBOOK PAGE CLAIMS HE WAS "THE JACKSON FAMILY'S HONOR PHOTOGRAPHER."
SEVERAL OF MURRAY'S RECENT FACEBOOK POSTS ARE ON THE NEWS COVERAGE OF BARBOSA.
IN ONE MURRAY WRITES: THE LAW IS IF YOU SEE AN EMPTY HOUSE THAT IS NOT BEING TAKEN CARE OF YOU CAN FILE THE PROPER PAPERS AND MOVE IN IT.
THAT IS THE LAW.
