KAREN AND JOHN DWYER HAVE BOXES FILLED WITH LETTERS, DRAWINGS AND CASE FILES FROM DEATH-ROW.
"We think he's innocent and we know that the justice system is not infallible."
GREGORY CAPEHART WAS SENTENCED TO DEATH IN 1989.
HE WAS CONVICTED BY A JURY FOR THE MURDER OF A 62-YEAR-OLD WOMAN IN DADE CITY.
MARLENE REAVES WAS ROBBED, RAPED AND SMOTHERED TO DEATH WITH HER OWN PILLOW.
30:05 There were no eye witnesses, there's no murder weapon, there's no concrete evidence in the form of dna 13 there's gregorys continual insistence that he's innocent 18 --- 32:50 I just want to make sure the right person is behind bars and I don't think gregory is the one 56
THE DWYERS GOT INVOLVED IN CAPEHARTS CASE TWELVE YEARS AGO--
BRINIGING HIS STORY TO THEIR STUDENTS AT LELY HIGH SCHOOL--
WHO STARTED A PETITION IN 2005, DEMANDING D-N-A TESTING OF THE CRIME SCENE EVIDENCE--
TESTING THAT WASNT AVAILABLE DURING CAPEHARTS TRIAL.
27:12 we figured the dna test was an easy way to see if he was innocent or guilty beyond a shadow of a doubt 18--- 27:40 that would give us as floridians peace of mind that were not executing the wrong people because execution is final, you can't take that back 48
THE TESTS WERE GRANTED-- BUT CAME BACK INCONCLUSIVE---
THE EVIDENCE DIDNT INCRIMINATE CAPEHART-- BUT IT ALSO DIDNT CLEAR HIM.
A JUDGE DECIDED TO VACATE HIS SENTENCE-- TAKING HIM OFF DEATH ROW--
BUT CAPEHART WASNT EXONERATED-- HE WAS RE-SENTENCED TO LIFE IN PRISON.
CAPEHART IS NOW 45-YEARS-OLD AND COULD BE UP FOR PAROLE NEXT YEAR--
SO THE DWYERS ARE TRAVELING TO TALLAHASSEE TO TESTIFY ON HIS BEHALF.
"To tell the parole people that we know a different Gregory than the one they do."
ASKING FOR A SPEEDY PAROLE--
OR A RETRIAL.
"Freedom is coming, were still hoping, hasn't happened yet."

IN OUR SPECIAL REPORT--
WHY HE SAYS KEEPING INFORMATION FROM THE PUBLIC WILL HELP SOLVE MURDERS.
AD LIB WEATHER TEASE
Return to index of stories...
THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.
IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.
COLD FRONT HEADED THIS WAY
The weather is about to change in southwest Florida … but not too dramatically and not before Thursday. The forecast tonight calls for variable clouds and I'm tracking a few, isolated showers inland. What little rain there is tonight is moving quickly off to the northwest and it looks like the urban corridor will be quiet this evening. Temperatures will drop slowly through the 60's tonight and the low tomorrow morning will be around 64 degrees.
The cold front coming this way will not be passing through here until early on Thursday morning. That means that tomorrow will be another warm and breezy day. Highs will easily hit the mid 80's tomorrow and winds will be southwesterly at 15 - 20 mph and gusty. Boaters: there is a Small Craft Caution posted for tomorrow. The humidity will be up on Wednesday and a couple of very isolated showers may develop inland once again. The change for rain goes up to 40% after midnight tomorrow and there will be showers passing through around sunrise on Thursday. High temperatures will drop back into the 70's and we will hold on to 70's for highs for several days. Overnight lows by Friday and Saturday will be chilly once again as thermometers register mid 40's on Friday and Saturday morning. It looks like our chance for rain is going to be limited to Thursday as the cold front passes through.
Enjoy the 80's tomorrow. They will be gone for a while after Thursday.

24 homicides.
1 year.
Only 5 arrests.
The reason according to fort Myers place chief Doug baker?
Sot chief baker
" We hear it from witnesses that are at the scene that come and talk to us but do not want to be identified as part of a criminal investigation because they don't want the public scrutiny."
Chief baker says people know who committed these and other crimes,
But they're not coming forward.
Sot chief baker
It's real that the possibility exists of retaliation that could result in serious injury or death. That real."
So real- the chief now asking legislators to change Florida public records laws.
Sot baker
It's to encourage someone to say, what did you see, what do you know, what did you hear, what transpired - I need that for probable cause to make the arrest, I need that information."
Today- they listened.
Sot rep. Heather fitzenhagen, r- fort Myers
What we've been able to do so far is not taking care of the problem."
Right now- police can restrict public knowledge based on pending investigations.
Once an arrest is made that information is released.
The chief wants that information held until trial.
Sot baker
It doesn't limit government transparency, the how and where still exists."
Baker says public record law are meant to hold government accountable,
Not limit investigations.
Sot fitzenhagen
"The right to know is very very important, and I'm not discounting that in any way but it hint we have to look at bold solutions and different ways to approach this problem and solve it."
A complete solution- still a long way off.
Sot baker
This is not the solution to violent crime in east fort Myers or Dunbar. I agree with that, however it's a strategy that we believe is needed to be successful."
