- it wouldn't take much to get this building up and running- it just

needs some furniture and the rest of this manufacturing equipment.

its money, but says it's all on the up and up. Return to index of stories...

VR LABS PAYMENT EXTENSION-BNR-PKG

What was supposed to be a bustling bottling facility for Bonita springs

based beverage maker VR Labs has turned into a dust covered broken

promise.

1554-1603

Frank Mann - lee co comm

I think it was a huge mistake for the county to support this and I was

a part of that. I regret it

This week- lee county lawyers sent a letter to the Bonita springs

based herbal drink maker.

It's Another in a long line that have gone unanswered.

In the letter, county attorneys say VR failed to live up to 3

agreements outlined in a contract. Most notably, the creation of 208

jobs.

Take sot

2140-7

Cecil Pendergrass

The way the agreement was originally proposed to VR labs, it gave a

long timeline to fulfill the jobs and performances. They were unable

to fulfill that.

VR Labs quickly fired back.

A spokesperson Claims the county's assertions are premature and

innaccurate- saying VR has until 2017 to fulfill its obligations.

Commissioner Cecil Pendergrass is fed up- hoping the company is held

accountable.

Take sot

Pendergrass

7 seconds

From day one I've been in office I've been supportive of the

investigation by the FBI which is still ongoing.

This project stalled after This building's contractor said he wasn't

getting paid- and claimed company executives were siphoning money for their

own gain.

The company has maintained it's done nothing wrong- but hasn't fronted

the money to finish the project.

With 5 million taxpayer dollars hanging in limbo,

A lack of jobs and a litany of lawsuits lurking- the question is what

will happen with this building, and the millions handed out.

Take sot

Mann

My greatest fear and all indications are is this money will never be

seen. Or only a fraction of it. Return to index of stories...

- if this threat of suing VR labs sounds familiar, it is- last month

FIRST ALERT FORECAST-WXWALL

After Southwest Florida enjoyed temperatures in the low 80s again this afternoon, the weather pattern will allow us to squeeze out one more nice day before a cool front comes down the peninsula with clouds, rain and cooler temperatures for the end of the work week.

Overnight, expect some patchy fog to develop late with lows in the low 60s. Wednesday will again be partly sunny and mild with highs in the low 80s. The beaches should peak just shy of 80º.

The cool front arrives late tomorrow night with showers beginning after midnight and lasting through the early part of Thursday. Clouds linger all day, which will hold highs in the low-mid 70s.

By Friday, the cool front pushes away, allowing the sun to return on Friday afternoon with highs in the mid 70s.

This weekend is looking great with highs back into the low 80s.

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.

WELCOME TO THE ALL AMERICAN DREAM.

A CORNER HOME WITH WHITE PICKET FENCE AND FAMILY DOG.

Nats of dog barking

Mark Yorkson - Homeowner // 11:52 we want to live in a place like that. 11:54

BUT THE PURSUIT OF HAPPINESS IS BECOMING HARDER TO ACHIEVE -

THANKS TO RISING PROPERTY INSURANCE RATES.

SOUTHWEST FLORIDA HAS NOT SEEN A MAJOR STORM IN EIGHT YEARS.

AND MARK YORKSON HAS NOT SEEN RELIEF.

Mark Yorkson - Homeowner // 13:07 mine have tripled. 13:10

13:20 it may have slowed down a little bit the last couple years but it hasn't gone down one iota. 13:27

BUT FLORIDA INSURANCE COMMISSIONER KEVIN MCCARTY SAYS EXACTLY THE OPPOSITE.

Kevin McCarty - Insurance Commissioner // 01:31 this is probably the best market we've seen since hurricane season 2004-2005. 01:36

168 CARRIERS WRITE INSURANCE IN FLORIDA.

THE REPORT MCCARTY CALLS 'OPTIMISTIC' FOCUSED ON ONLY THIRTY.

OF THOSE, ONLY EIGHT AGREED TO LOWER THEIR RATES.

CUSTOMERS FROM SIX COMPANIES WILL SEE THEIR RATES GO UP.

Kevin McCarty - Insurance Commissioner // 03:03 there are other costs of additional costs such as trends or non-catastrophic losses that are specific to an individual company, so you will see some rate increases. 03:12

IF YOU'RE ONE OF THE LUCKY ONES SEEING A REDUCTION - IT'S ONLY ON A PORTION OF YOUR PREMIUM CALLED RE-INSURANCE.

THAT'S INSURANCE, INSURANCE COMPANIES USE TO PROTECT FROM LOSSES.

THE REPORT SHOWS AN AVERAGE RE-INSURANCE REDUCTION OF ABOUT 5%.

Tim Shaw - Insurance Expert // 45:50 overall when your average premium is $2,000 and somebody says here I'm going to save you $40 this year, I don't think it makes you feel real good. 45:55

ANOTHER THING THAT WON'T MAKE HOMEOWNERS FEEL REAL GOOD?

FLORIDA'S LARGEST INSURER, CITIZENS, IS NOT INCLUDED.

Tim Shaw - Insurance Expert // 42:30 I don't know that they wanted that in the report because Citizens rates are going to continue to go up. 42:36

THAT'S THE OPINION OF INSURANCE EXPERT TIM SHAW --

WE ASKED MCCARTY WHY HE LEFT OUT A CARRIER REPRESENTING 20% OF THE MARKET.

Kevin McCarty - Florida Insurance Commissioner // 05:42 we just looked at the private sector market, which would really be benefiting from the changes in the reinsurance market. 05:47

SHAW SAYS HE BELIEVES THIS IS LESS ABOUT FINDING RELIEF FOR CUSTOMERS AND HAS MORE TO DO WITH POLITICS.

YOU SEE, FLORIDA C-F-O JEFF ATWATER COMMISSIONED THE REPORT.

Tim Shaw - Insurance Expert // 52:57 Atwater wants his job and he wants to get reelected so he's doing all the things that politicians do, saying all the things politicians say in an election year. 53:05

THE NBC2 INVESTIGATORS SENT DOZENS OF REQUESTS TO ATWATER'S OFFICE FOR AN ONCAMERA INTERVIEW; BUT HE WAS NEVER AVAILABLE TO TALK WITH US.

HIS OFFICE DID SEND A STATEMENT SAYING IN PART -

"I share the Commissioners expectations. Floridians deserve relief."

BUT IS THERE REALLY ANY?

Kevin McCarty - Insurance Commissioner - 09:54 they want to know will my rates go down this year, right now? What can you say to that point? Well, unfortunately the process doesn't work that way. 10:02

MEANING IT WILL TAKE TIME -

THAT IS IF WE DODGE ANOTHER STORMY SEASON.

mark Yorkson - Homeowner // 13:34 I don't have any false hope that things are going to get any better. 13:38 Return to index of stories...

INSURANCE INVESTIGATION-BUBBA, Q&A

THE 30 COMPANIES IN THE REPORT CONTRIBUTED VOLUNTAIRLY.

MCCARTY CONCLUDES CONSUMERS ARE BENEFITING IN TWO WAYS.

FIRST, HE SAYS SOME PEOPLE ARE SEEING LOWER RATES AND SECONDLY -

BECAUSE INSURERS CAN PURCHASE MORE RE-INSURANCE TO ENHANCE CLAIMS PAYING ABILITY.

SO JIM, MCCARTY STILL BELIEVES THIS IS AN ACCURATE REPRESENTATION OF THE MARKET WITHOUT CITIZENS AND MORE THAN 100 OTHER COMPANIES REPRESENTING THE MARKET?

NOT JUST MCCARTY, BUT C-F-O JEFF ATWATER TOO, WHO APPROVED THE REPORT.

BUT HERE'S THE REALIZATION. IT'S MISSING 30% OF POLICES OUT THERE, MAKING IT TOUGH TO GET A TRUE FEEL.

BUT WHEN PRESSED ON THAT NOTION, MCCARTY WAS ADMANENT THE REPORT SHOWS A POSITIVE SIGN FOR CONSUMERS -

JUST TAKE A LOOK AT YOUR POLICY AND SEE IF YOU AGREE WITH HIM.
