A HEATED DEBATE IN COLLIER COUNTY TONIGHT -- HOW FAR IS TOO FAR WHEN IT COMES TO HOMEOWNERS ASSOCIATION RULES?

THE LAGUNA VILLAGE IN FIDDLERS CREEK OFF 951 IS CONSIDERING A BAN ON SMOKING -- EVEN BY HOMEOWNERS -- ON THEIR OWN PROPERTY.

NBC2'S RICK RITTER HAS THE STORY. Return to index of stories...

NO SMOKING HOA-PKG

TRT = 1:20

FROM SAN FRANCISCO TO SOUTHWEST FLORIDA - LINDA AND TONY FIORE TRADED IN STRESS FOR RELAXATION.

Linda Fiore/Laguna Village Resident/9:21:27 "Lifestyle is a no-brainer, you just relax, people don't care and go with the punches."

BUT LATELY THEIR RELAXATION COMES WITH SOME CONTROVERSY -

Tony Fiore/Laguna Village Residents/9:17:12 "It was like wow, somebody is paying attention to a need that everyone is asking about."

LAGUNA VILLAGE IS THE LONE COMMUNITY IN FIDDLERS CREEK CONSIDERING A SMOKING BAN ON ITS 128 PROPERTIES.

AFTER A HOMEOWNERS ASSOCIATION MEETING EARLIER THIS WEEK - SEVERAL RESIDENTS COMPLAINED ABOUT THE SMOKE - AND HOW IT'S TRICKLING OVER FROM ONE LANAI TO ANOTHER.

Leslie/Laguna Village Resident/9:24:02 "I'm sure initially no one thought this would be such a problem for someone but it actually really is and it effects peoples health."

THE BAN WOULD PREVENT HOMEOWNERS FROM SMOKING IN ALL COMMON AREAS INCLUDING THEIR LANAI.

THESE HOMES ARE FAR FROM CHEAP - AND THE ASSOCIATION FEES CAN BE TOP DOLLAR- ONE REASON WHY SOME RESIDENTS SAY THE CHOICE, SHOULD BE THEIRS.

Linda Fiore/9:19:26 "I'd be very upset if I purchased a home with the price they're at out here and someone told me I couldn't smoke."

RESIDENTS SAY THE BOARD WILL SEND OUT A POLL - LETTING THEM VOICE THEIR OPINION.

BUT ULTIMATELY, THE BOARD WILL DECIDE.

MEANING THE DAYS OF LIGHTING UP COULD BE NUMBERED.

Ellen Cantor/Laguna Village Resident/9:28:11" they make the decision and that's what their elected to do , it's a tough one, really is."

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.

IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.

Clouds and cooler air filtered into Southwest Florida Thursday, with highs only in the low 70s. Rain showers are developing in the Gulf of Mexico, and these showers will push into the area through the evening time frame. The showers should slowly diminish overnight, with lows in the mid 50s.

The weekend still looks great across the area. Expect plenty of sunshine both days with low humidity values. Highs on Saturday will be in the low 80s, with temps on Sunday in the low to mid 80s.

The nice weather continues into next week. A few more clouds will appear starting Monday, with highs in the mid 80s. Dry weather continues into Tuesday, with temps in the low 80s.

Our next storm system will likely arrive midweek, which will bring a good chance of showers and possibly storms to the area. Return to index of stories...
