FIRST ALERT FORECAST-WXWALL

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.

IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.

"A FEW STORMS TODAY"

The summer-like heat won't stop across Southwest Florida. Yesterday we officially topped out at 92° and while this isn't one for the record books, it's still about 5° above average. The trend of hot and humid days will continue before relief comes in the form of scattered rain by late in the week.

A good amount of sunshine will prevail through the late morning hours, allowing temperatures to climb quickly into the middle to upper 80s by noon. During the afternoon expect partly sunny skies to take over along with a southerly wind. This will continue to pump in more heat and moisture across the area. This combined with the seabreeze will allow for a few downpours and storms to develop along and east of the interstate. Daytime highs will eventually top out in the lower to middle 90s, with cooler readings at our beaches and coastal locations.

A very slight shower chance will continue through the evening hours, and temperatures will begin to settle into the lower 80s by sunset. Due to the extra humidity, temperatures will be slow to fall overnight as they bottom out in the lower 70s.

A slow moving storm system that continues to kick off rounds of severe weather across the south, will push itself down the Florida peninsula in a much weakened state. This will bring us a slight uptick to our rain prospects beginning Friday. As this front drapes itself across the southern half of the state, expect more clouds than sun Friday and Saturday with scattered rain and a few storms. Skies will turn a bit sunnier by late Sunday with drier weather building over the state. Return to index of stories...

"I notified the Attorney General's office, the Governor's office with my intent to stop the execution."

DOC DIRECTOR ROBERT PATTON SAID LOCKETT RECEIVED HIS FIRST INJECTION AT 6:23 PM HOWEVER LOCKETT MAINTAINED SOME CONSCIOUSNESS AND WITNESSES SAY HE SLOWLY BEGAN CONVULSING. MINUTES LATER A DOCTOR IN THE ROOM DECIDED TO STOP THE EXECUTION AND AT 7:06PM, 43 MINUTES AFTER HIS FIRST INJECTION, LOCKETT SUFFERED A HEART ATTACK AND DIED INSIDE THE EXECUTION ROOM.

"That is it. That's my statement. That's all the information I have at this time."

"This was a horrible thing to witness. One of the things he said is something is wrong. He said man at one point. He kept trying to raise up."

DAVID AUTRY IS ONE OF LOCKETT'S ATTORNEYS. HE HAD ARGUED THAT THE STATE'S SECRECY LAW REGARDING THE LETHAL INJECTION DRUGS VIOLATED HIS CLIENT'S 8TH AMENDMENT RIGHTS PROTECTING AGAINST A CRUEL AND UNUSUAL PUNISHMENT. NOW HE SAYS TUESDAY'S DISASTER PROVES THE STATE RUSHED INTO THIS EXECUTION WITH AN UNPROVEN MIX OF DRUGS.

PETE WILLIAMS REPORTS. Return to index of stories...

CELL PHONE WARRANTS-TRX PKG

What's on YOUR cell phone? More than 90 percent of Americans have them -- nearly two-thirds: smart phones.

And with 13 million people arrested every year -- most for minor offenses.

. defense lawyers say police should have to get a search warrant to rummage through the cell phones of anyone they arrest.

. because smart phones can contain so much private information -- medical records, political and religious affiliations, even intimate pictures.

"What's at issue is whether or not the police in every arrest, no matter how minor the offense, and no matter whether they have any reason to think they have to look right away, can do a full exploratory search of someone's digital device.":11

But the Obama administration joins police officers who say criminals use cell phones as a tool:

"There is one involved in every crime, either as a facilitator of the crime or as an eyewitness to the crime. It's extremely valuable."

Courts have long held that police do not need a warrant to search anything they find on people they arrest, including purses or wallets.

The question: should phones be treated the same?

Justice Alito asked, "What's the difference between looking at photos in a billfold and saved in the memory of a cell phone?"

But Justice Sotomayor said a billfold is one to five photos. With cell phones, she said, we're talking about potentially thousands.

And Justice Kagan said people carry their entire lives on cell phones.

The likely outcome: a middle ground, with police allowed to search phones for evidence in serious crimes, but not to hunt through them in minor ones. Pete Williams, NBC News, at the Supreme Court Return to index of stories...

THE AMERICAN LUNG ASSOCIATION'S ANNUAL "STATE OF THE AIR" REPORT FINDS PARTICLE POLLUTION IS DOWN THANKS TO CLEANER DIESEL FUEL AND POWER PLANTS

BUT OZONE POLLUTION IS UP, MEANING THERE'S LESS STUFF FLOATING AROUND. BUT SMOG IS WORSE.

THE LUNG ASSOCIATION BLAMES WARMER WEATHER:

"Which is bad news for public health." "It shows we need to take the threat of climate change very seriously."

THE ASSOCIATION SAYS POLLUTED AIR CAN LEAD TO MORE ASTHMA, HEART ATTACKS AND STROKE.

IN ALL, THEY COUNT 147 MILLION PEOPLE - ALMOST HALF THE COUNTRY - LIVING IN UNHEALTHY AIR.

AND THERE WERE STARK DIFFERENCES:

LOS ANGELES SAW RECORD LOW PARTICLE POLLUTION LAST YEAR. BUT HAD MORE HIGH OZONE DAYS THAN THE YEAR BEFORE.

IN FACT, ALL BUT THREE OF THE TOP 25 CITIES SAW OZONE LEVELS INCREASE.

THE REPORT COMES JUST HOURS AFTER THE U-S SUPREME COURT RULED 6 TO 2 THAT THE FEDERAL GOVERNMENT CAN POLICE PARTICLE POLLUTION THAT FLOATS ACROSS STATE LINES.

DRESSING FOR THE DERBY-TRX PKG

Carolyn Manno: "Make sure to save the date, Saturday, May 3rd on NBC. It's the Kentucky Derby. Hi everyone Carolyn Manno from NBC Sports lucky enough to be joined by Stylist expert Stacy Smallwood. Stacy when we are talking about the Kentucky Derby so much of it is fashion and hats and dresses. What is the key thing to remember?"

Stacy Smallwood: "Having fun. Fashion is about expressing yourself and at the Derby you bring out your fun side. And you do that with a great pop of color like the dress your wearing today. We brought two models to show you some other ideas. I love this long New Kenzo- hot pink, teal- really stands out. And this great little, Elle Sasson a new designer, beads and color."

Carolyn Manno: "When you are talking about buying an outfit versus a hat. Which comes first? Do you buy the hat first? Do you buy the dress first?"

Stacy Smallwood: "I think a dress is hard to find. It's hard to find the perfect piece to fit your body shape. So let's do the hard work first and then have fun and accessorize with a great hat."

Carolyn Manno: "For men, how much should they accessorize and are hats going to be on trend for men again this season?"

Stacy Smallwood: "You know what a traditional seersucker suit is always on point. And we showed one here. But, I think it is nice that men are getting into color these days. So we brought a great model here today we did a little pink checker button down, a linen sport coat, and we finished it off yes with a hat."

Carolyn Manno: "Yea, that linen sport coat is beautiful as well. Okay, everyone get your fashion together. Ready, Set, Go. The Kentucky Derby on May 3rd. We will see you there." Return to index of stories...
