Appearing before the judge for the first time

"Good morning"

Cape coral police officer Casey Ortiz stood silent as the charges were

read allowed.

"Sexual assault by a 24 year old of age or older sexual battery on a

victim 16 years of age"

Tonight, Ortiz's lawyer sat down with NBC2 to discuss the allegations

"Please don't make mr Ortiz the devil in sheep's clothing because he

is a good officer and he's been doing gods work for a very very long

time"

According to detectives Ortiz sexual relationship with a 16 year old

was first noted back in February.

Accused of picking up the teen in his cop car several times to have sex.

The teen's parent reported it to police.

"We're curious as to why it was reported so late supposedly it

happened months before it was reported so we don't understand that"

Shortly after Ortiz was fired.

Investigators say probe into Ortiz's phone records also showed a

relationship with the minor.

"A motivated young man I thought he had the background he had a lot

going for him"

Larry Hoskins says he'd rather not think of a Ortiz as disgraced cop

considering a month before the investigation started he'd written a

thank you note when Ortiz came to his aide

"Nothing good will come out of this I'm afraid even if he's exonerated

and everything is found completely innocent of any charges the

community will still have a very bad feeling about it"

Meanwhile Ortiz's attorney says he's waiting on evidence to prepare

his case to defend his client

"We really don't have our side of the story yet because we don't known

INVESTIGATORS SAY IN 2006 - AKERS WAS BY HIMSELF IN HIS APARTMENT - WATCHING HIS FIANCE'S DAUGHTER - ABIGAIL- WHEN HE DROPPED HER.

AKERS CLAIMED SHE FELL OFF THE BED.

THE LITTLE GIRL SUFFERED SKULL FRACTURES, BRAIN INJURIES AND LATER DIED.

PROSECUTORS DAVE SCUDERI AND STEVE MARESCA SAY EVIDENCE WILL SHOW THAT NO ONE ELSE COULD HAVE INFLICTED THE PAIN ON ABIGAIL OTHER THEN AKERS - WHO WAS ALONE WITH THE 2-YEAR-OLD.

THE FIRST DEPUTY ON SCENE THAT NIGHT SAYS AKERS FIRST SAID THE 2-YEAR-OLD FELL OFF THE BED BUT LATER CHANGED HIS STORY.

RAIN AND STORM CHANCES INCREASE

It was another hot and humid Thursday across Southwest Florida, with highs again climbing into the low 90s. Scattered showers and storms again developed inland, and this activity will slowly diminish this evening. Expect another muggy overnight, with lows in the low 70s.

Rain and storm chances continue into Friday. More cloud cover is expected, with the best chance for rain in inland areas. Highs on Friday will be in the upper 80s.

Our next storm system rolls in on Saturday. Expect plenty of cloud cover as well as a good chance for showers and possibly a few storms in the area. Highs on Saturday will be in the mid 80s.

The system exits on Sunday, with gradual clearing occurring and sunshine expected by afternoon. Drier and less humid air will also filter in, with highs expected to be in the mid to upper 80s.

Quiet weather is expected for most of next week, with plenty of sun and highs Monday & Tuesday climbing into the upper 80s.

The humid air slowly returns midweek, with a slight rain chance by next Thursday.
