FORT MYERS POLICE CALL IT A DRUG HAVEN --

TODAY -- THEY'RE ONE STEP CLOSER TO SHUTTING DOWN THE PALM AVENUE GROCERY.

A SMALL NEIGHBORHOOD STORE IN DUNBAR --

SITTING ON THE CORNER OF PALM AVENUE AND LEMON STREET --

THIS BRIGHT BLUE STORE IS HARD TO MISS --

"I think it's an asset to the community."

FOR PEOPLE LIKE FREDDIE CHURCH -- IT'S A CONVENIENT PLACE TO GET FOOD AND DRINKS.

"A lot of people rely on it. some people dont got vehicles or nothing like that."

BUT FOR THE PAST TWO YEARS THE CITY HAS TRIED TO SHUT PALM AVENUE GROCERY DOWN.

ACCORDING TO THE FORT MYERS POLICE DEPARTMENT -- THERE WERE NEARLY 23-HUNDRED CALLS FOR SERVICE IN FIVE YEARS LEADING UP TO 2012 --

SOON AFTER, THE CITY VOTED TO CLOSE IT AFTER POLICE SAID DRUGS WERE BEING SOLD IN AND OUT OF THIS STORE.

"We're going to take action, and that's what we did."

TODAY -- CITY ATTORNEY GRANT ALLY IS CELEBRATING A VICTORY --

A FEDERAL JUDGE DISMISSED A LAWSUIT BROUGHT BY THE STORE OWNER CLAIMING THE CITY'S DECISION WAS UNCONSTITUTIONAL.

NOW THE CITY PLANS TO TAKE THE CASE TO A STATE JUDGE FOR PERMISSION TO CLOSE THIS STORE FOR ONE YEAR.

"If the open and notorious drug dealing stops and the nuisance stops, then the litigation stops."

ATTORNEY WILLIAM POWELL REPRESENTS THE STORE OWNER --

HE SAYS STEPS HAVE BEEN TAKEN TO CLEAN THINGS UP.

SIGNS AND CAMERAS HAVE BEEN INSTALLED, AND AND THE OWNERS HAVE EVEN CHANGED THEIR HOURS.

SO FAR THIS YEAR -- WE FOUND OUT POLICE RESPONDED TO THIS STORE 77 TIMES -- MAINLY FOR EXTRA PATROLS.

FREDDIE CHURCH SAYS THERE USED TO BE PROBLEMS --

"Used to be, not any more."

TODAY -- HE HOPES THE STORE CAN STAY OPEN.

'It's a neighborhood store. It's for the neighborhood." Return to index of stories...

FIRST ALERT FORECAST-WXWALL

THIS WEATHERCAST HAS BEEN PREPARED BY THE NBC2 WEATHER STAFF.

IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.

Scattered storms will roam through Southwest Florida for the balance of the afternoon and evening, and a few of today's storms may be intense with frequent cloud-to-ground lightning, heavy rain and gusty winds.

The storms will be scattered in nature with the highest storm coverage expected over our inland communities, but even our coastal zones may see a passing storm before the evening is done.

After topping out in the low to mid 90s this afternoon, temperatures will settle into the mid 70s overnight into early Thursday morning.

We'll end up back in the low to mid 90s for Thursday afternoon with a blend of sunshine and clouds, and expect scattered storms to fire up during the heat of the day and into the evening.

Storms will be possible anywhere tomorrow, but the highest rain chances will be across our inland communities.

Expect a slight downward trend in rain chances for the upcoming weekend, but we'll still have enough moisture in place for some isolated afternoon storms.

Temperatures will continue peaking in the low to mid 90s during the day and cooling down into the mid 70s at night. Return to index of stories...
