MIAMI DADE GAY MARRIAGE-trxVOTOPS

THIS COMES IMMIDIATELY FOLLOWING A MIAMI JUDGE'S RULING ON THE STATE'S BAN ON SAME-SEX MARRIAGE.

THE JUDGE SAYS, THE VOTER-APPROVED BAN DENIES SAME-SEX COUPLES THEIR CONSTITUTIONAL RIGHT TO EQUALITY.

FLORIDA ATTORNEY GENERAL PAM BONDI FILED NOTICE OF APPEAL.

THE JUDGE DELAYED THE EFFECT OF HER RULING TO ALLOW TIME FOR APPEALS.

MIAMI - A Florida judge has overturned the state's ban on same-sex marriage in a ruling that applies to Miami-Dade County, agreeing with a judge in another county who made a similar ruling last week.

The ruling issued Friday by Circuit Judge Sarah Zabel applies only in Miami-Dade County. The Monroe County judge's ruling last week was stayed when Attorney General Pam Bondi filed notice of appeal. Zabel also stayed the effect of her ruling indefinitely to allow for appeals.

Both rulings found the same-sex marriage ban approved by voters in 2008 violated the U.S. Constitution's guarantee of equal protection under the law.

Bondi and ban supporters argued the referendum vote should be respected and that Florida has authority to define marriage in the state as between one man and one woman. Return to index of stories...

FORECAST-WXWALL

A slow moving thunderstorm dropped up to 3" of rain on parts of downtown Fort Myers this afternoon.

Though activity today along the coastal areas has been somewhat isolated in total coverage, areas seeing rain have picked up a considerable amounts. Through this afternoon and evening these slow moving storms will continue to drop locally heavy rainfall before they continue to weaken toward sunset.

Temperatures overnight tonight will range from the mid to upper 70s, with warmer temps hugging the coastal areas

For Sunday, we will see a southern component to the wind early in the day. With that we'll be expecting to see some morning showers or isolated downpours move along the coastal areas in into the mid-day hours. Coverage should be kept mostly to areas west of I-75.

Into the afternoon on Sunday though, we will be monitoring some drier air in the mid and upper levels of the atmosphere. That will help to cut back on the overall coverage of rain the region is able to see on Sunday afternoon. Any rainfall should be isolated, and mainly kept in parts of the interior of the state near Hendy, Glades and interior Collier Counties.

This mass of somewhat drier air in the atmosphere will keep rain opportunities isolated Monday and Tuesday. Temperatures should be allowed to return to the low and mid 90s during the afternoon hours.

TROPICAL UPDATE

A Tropical wave located just off the west coast of Africa is being noted on satellite. The National Hurricane Center is offering this disturbance a 0% chance of organization in the next two days and a 20% chance of development in the next five.

Otherwise there are no tropical cyclones active and none are expected to develop in the next two days across the Atlantic, Caribbean or Gulf of Mexico.
