BREAKING NEWS TONIGHT AT 11 OUT OF JACKSONVILLE.

A JURY REACHES A GUILTY VERDICT IN THE CASE OF MICHAEL DUNN.

DUNN KILLED A TEEN DURING AN ARGUMENT OVER LOUD MUSIC.

THE SELF-DEFENSE CASE DREW COMPARISONS TO THAT OF GEORGE ZIMMERMAN,

WHO WAS ACQUITTED OF KILLING 17 YEAR OLD TRAYVON MARTIN.

CRISTINA MUTCHLER REPORTS. Return to index of stories...

DUNN GUILTY VERDICT-PKG

As to count one I will declare that mistried.

A FLORIDA JURY WAS UNABLE TO AGREE ON WHETHER MICHAEL DUNN COMMITED FIRST-DEGREE MURDER WHEN HE KILLED 17-YEAR-OLD JORDAN DAVIS IN NOVEMBER 20-12.

THIS WAS THE MOST SERIOUS CHARGE DUNN FACED.

HOWEVER, THE JURY DID FIND HIM GUILTY ON THREE COUNTS OF ATTEMPTED MURDER and ONE COUNT OF SHOOTING INTO A CAR.

DUNN SHOT AT AN S-U-V CARRYING DAVIS AND THREE OF HIS FRIENDS, AFTER AN ARGUMENT OVER LOUD MUSIC IN A JACKSONVILLE PARKING LOT.

DUNN AND HIS LAWYERS CLAIMED THE 47-YEAR-OLD ACTED IN SELF-DEFENSE, FEARING FOR HIS AND HIS GIRLFRIEND'S SAFETY,

Attorney: You thought everyone in the car was a thug or a gangster, right?

Dunn: After the way they behaved, yes I did.

THE PROSECUTION SET OUT TO DISMANTLE THE SELF-DEFENSE ARGUMENT.

This defendant took it upon himself to silence Jordan Davis forever. Even people who have the right to self defense, do not have the right to take the life of a child when that self defense is unreasonable.

PRIOR TO THE VERDICT, DUNN'S ATTORNEY SAID HE BELIEVED HIS CLIENT GOT A FAIR TRIAL -- BUT HOPED THE JURY RECOGNIZED HIS CLIENT'S POSITION.

It was actually Jordan Davis who escalated it, and when my client didn't react and actually went to talk to him, that's when it got worse.

THE 12 PERSON JURY DELIBERATED FOR OVER 30 HOURS FOR FOUR DAYS.

I'M CRISTINA MUTCHLER REPORTING. Return to index of stories...

EVEN OPPONENTS OF LEGALIZED POT ADMIT THIS WAS A PROBLEM.

MARIJUANA COMPANIES HAVE A VERY HARD TIME GETTING BANK ACCOUNTS.

SOME EVEN DO ALL THEIR BUSINESS. INCLUDING PAYING STATE TAXES. IN CASH.

HARDLY A SAFE WAY TO GO.

ACCORDING TO THE FEDERAL MEMO. BANKS WHO WANT TO HANDLE MARIJUANA MONEY HAVE TO JUMP THROUGH A FEW HOOPS.

THEY'LL NEED TO VERIFY THE LICENSE OF THE POT COMPANY AND MONITOR HOW THEY FOLLOW STATE REGULATIONS.

BANKS WILL ALSO HAVE TO REPORT SUSPICIOUS ACTIVITY TO THE FEDS.

FEDERAL OFFICIALS SEEM CONFIDENT THIS WILL MAKE IT EASIER FOR POT SHOPS TO GET BANK ACCOUNTS. SAYS NBC JUSTICE CORRESPONDENT PETE WILLIAMS.

"They expect many banks will do this, will be willing to go through these steps, file these reports and they especially say they expect demand to be heavy from both Colorado and Washington state."

BUT BANKS DON'T SEEM SO SURE.

"Unfortunately, it still amounts to a red light. They still make it clear financial institutions may be prosecuted for servicing the marijuana industry, and they provide no waiver from that prosecution."

THEY WANT CONGRESS TO PASS A LAW EXPLICITLY ALLOWING THEM TO DO BUSINESS WITH MARIJUANA COMPANIES.

A CAUSE BEING CHAMPIONED BY DEMOCRAT ED PERLMUTTER OF COLORADO.

"This is not the end of the banking issue. There still needs to be in my opinion, legislative work done, but it's a good step forward."

FULL WX

THIS WEATHERCAST HAS BEEN PREPARED BY THE ABC7 WEATHER STAFF.

IT IS NOT A VERBATIM OF WHAT IS BEING SAID, BUT IS THE FORECAST FOR OUR AREA.

We've got a clear and chilly evening in the works Southwest Florida as another shot of cool, dry air flows into the region behind today's front.

Temperatures fall into the 50s shortly after sunset and then into the mid 40s late tonight into early Sunday morning. Some of our inland communities may even manage to get down into the upper 30s and low 40s by Sunday morning, especially for places like Arcadia, Palmdale, and Moore Haven.

After a chilly start to our Sunday, temperatures will warm up nicely through the day with clear, sunny skies expected from start to finish. Highs will mainly be in the mid 70s, except along the beaches where temperatures top out around 70 degrees thanks to a cool wind coming off the Gulf of Mexico.

Sunday night will be cool but not as cool as tonight. We begin our Monday morning with temperatures down in the low 50s, and then we warm up to around 80 by the afternoon.

Sunshine will be plentiful this week, particularly Monday through Wednesday, and we won't have much of a rain chance to speak of all the way through the end of the week.

Temperatures will be the main focus for the second half of the week as daytime highs warm all the way into the mid 80s from Wednesday into the upcoming weekend. Return to index of stories...

AN OHIO BUS DRIVER IS SUSPENDED WITHOUT PAY AND FACING CRIMINAL CHARGES AFTER SHE WAS CAUGHT ON CAMERA SLAPPING AN 8-YEAR-OLD AUTISTIC BOY.

JACK SHEA HAS THE STORY. Return to index of stories...

BUS DRIVER ASSAULT-PKG

What's the matter darling? Come here.

JANUARY 17TH, A CAMERA IS ROLLING ON AN ASHLAND CITY SCHOOL BUS AS DRIVER CATHY GOETZ INTERACTS WITH AN EIGHT-YEAR-OLD AUTISTIC BOY, WHO WAS UPSET WHEN HE GOT ON THE BUS. GOETZ WOULD LATER TELL INVESTIGATORS SHE DID NOT KNOW THE CHILD WAS AUTISTIC AND WHEN HE STARTED SCREAMING, SHE ASKED HIM TO BE QUIET.

What is the problem? Stop, now. You touch me and you're going to be in a lot of trouble.

THE BOY CONTINUES TO SCREAM AND THE VIDEO SHOWS CATHY GOETZ EVENTUALLY STOPS THE BUS AND CONFRONTS HIM.

That is enough. Enough. Stop it. .

AFTER GOETZ SMACKS THE BOY IN THE FACE, HE CAN BE HEARD THREATENING HER.

I'm going to kill you.

AND THAT'S WHEN CATHY GOETZ CALLS THE BUS DISPATCHER, WHO CALLS 911.

We have a situation with one of the buses for Ashland City Schools. There's a kid going crazy on one of our buses.

What bus number is it? It's bus 29, I can hear the kid in the backround sreaming. He said he's going to kill her and everything. It's crazy.

Stop it now. No. Keep it up. No. The police are coming for you right now.

AS GOETZ WAITS FOR ASHLAND POLICE TO ARRIVE, THE AUTISTIC BOY COTNINUES TO SCREAM AND STOMP HIS FEET AND THAT?S WHEN GOETZ GRABS HIM.

Enough. No. You heard me. No. You heard me. No. Enough.

GOETZ THEN TRIES TO LEARN MORE ABOUT THE BOY FROM HIS BROTHER, WHO IS SITTING AT THE BACK OF THE BUS.

Right here, kicking me and hitting me and screaming bloody murder.

WHEN AN ASHLAND POLICE OFFICER GETS ONTO THE BUS AND ESCORTS THE BOY OFF, CATHY GOETZ TELLS HIM THAT THE EIGHT-YEAR-OLD THREATENED HER AND HIT AND KICKED HER, BUT DOES NOT TELL HIM THAT SHE SLAPPED THE BOY AND GRABBED HIM AROUND THE COLLAR. Return to index of stories...

RUNNING FREE.CHASING OTHER ANIMALS.AT THE DOG PARK IT'S JUST WHAT'S EXPECTED.

He does like to chase squirrels a lot that's his favorite thing. And deer also

IT'S THOSE KIND OF ANIMALS.PROTECTED BY COLORADO LAW.THAT COULD GET YOUR CANINE IN SERIOUS TROUBLE.

AND IN COLORADO ITS NOT UNUSUAL TO SEE WILDLIFE CLOSE TO HOME.SOMETIMES IN THE MOST UNEXPECTED PLACES.

Under state law, if they see a dog that is harassing wildlife, law enforcement officers have the authority to put the dog down. They can shoot your dog.

IT'S BEEN ON THE BOOKS FOR DECADES, BUT.

Really, that's crazy.

NOT EVERYBODY KNOWS.

I think they need to make people more aware of it. Because I don't think people are.

That would be really upsetting bc I think its a natural instinct for them to chase animals

WHAT'S NATURAL ISN'T WHAT'S LEGAL WHEN WILD ANIMALS ARE BEING KILLED AND HURT.

We assume it was attacked by some dogs

THIS ELK CALF WAS FOUND SEVERELY INJURED ON SOMEONE'S PORCH IN STEAMBOAT SPRINGS.

We had to put it down

PARKS AND WILDLIFE SAYS STATEWIDE IT GETS REPORTS OF DOMESTIC DOG ATTACKS A FEW TIMES A WEEK.

AND EVEN JUST A FRIENDLY CHASE.

Deer and elk spent the entire summer and fall consuming food. They fatten up

ISN'T HARMLESS AFTERALL.

What happens when your dog goes out and chases that deer it utilizes some of that energy and that's the energy it needs to survive the winter in Colorado.

SPOKESMAN RANDY HAMPTON SAYS OFFICERS SHOOTING DOGS IS RARE.

It may happen once or twice a year

AND A LAST RESORT.

That's not what anybody wants to do, we all have dogs love dogs theyre part of the family.

And we understand that but we also have an obligation to protect colorado's wildlife Return to index of stories...
