MISSOURI EXECUTION STAY

NEW: Missouri execution on hold after late stay granted

ST. LOUIS - A Missouri execution has been delayed until at least midday Wednesday after a federal judge granted a last-minute stay.

John Middleton was scheduled to die one minute after midnight Wednesday for killing three people in rural northern Missouri in 1995. Less than two hours before the execution, U.S. District Judge Catherine Perry granted a stay, ruling that there was enough evidence of mental illness that a hearing should be held.

Courts have established that executing the mentally ill is unconstitutional.

Missouri Attorney General Chris Koster appealed to the 8th U.S. Circuit Court of Appeals, but that court adjourned for the night without a ruling.

The state could still execute Middleton at any time Wednesday if the stay is lifted. Return to index of stories...

Rockets fill the sky over Gaza -- Israel threatening to intensify its attack

against Hamas.

In northern Gaza, the Israeli military warned Palestinians to clear out -

more attacks are imminent. The message was delivered using automated calls

and text messages.

About 20% of Gaza City's 500,000 residents were given just eight hours to

leave. It's not clear where they're headed.all UN shelters are full.

The Israeli airstrikes resumed after Hamas rejected a ceasefire proposal,

and then launched rockets from Gaza.

Many Palestinians want the fighting to continue.

people will assign romance to the term date, but really this is about a

father and a daughter spending beautiful time together, bonding together,

respecting one another and having a really good time.

Area wide many will struggle to get out of the upper 80s, those that do stay right around 90° or 91°.

Some storms will still be going heading into the early evening hours tonight. After those fizzle out, clouds begin to dissipate.

Onshore flow will increase the changes for more morning storms again Thursday morning. Overall Thursday's forecast looks to be very similar to what were expecting today.

Shoppers who noticed two young children trapped inside a hot car in Houston smashed open the vehicle's windows to rescue them, witnesses said. Gabriel Del Valle, who was working in a store at the strip mall where the incident occurred, said someone came rushing into his store Monday, saying there were children stuck in a parked car.

When Del Valle emerged from the store, he saw a group of people banging on the windows and doors of a Jeep, trying to smash them or pry the door open, he told ABC News today.

"Pretty much I'm just working like a normal day and a guy comes in rushing and he's like 'somebody left their kids in their car,'" Del Valle said.

"The guys had to break the window, they had to bring a big sledge hammer and break the window and then a lady had to climb in to open the door," he added.

The mother of the children had accidentally locked the kids inside the vehicle and had been seeking help to get them out.

Inside the car were two children, ages 3 and 5, Del Valle said.

"Texas is famous for being hot so just imagine after rain, it's real humid over here. I don't know if it was 100 but it was close to that. It's good to see that people wanted to help," he said.

No one called police, though Del Valle said they did discuss it.

"After she left people wanted to call the cops, but we said, no, she made a mistake, you've got to learn from your mistakes. You don't know the situation she's under, you know, she could be a single mom or something," he said.

Del Valle said he filmed the scene because it seemed so relevant to other current news stories about children being left in hot cars, including the Georgia father who was arrested earlier this month after his son was found dead in the car. Return to index of stories...
